Regulatory Division

SUBJECT: CEMVR-OD-P-2013-0261

Ms. Gayleen Lowe Western Area Power Administration 200 4th Street SW Huron, South Dakota 57350

Dear Ms. Lowe:

Our office reviewed your application received on February 17, 2021, concerning your request for a Jurisdictional Determination for the Fort Randall-Sioux City 230kV Transmission Line, Structure 103/4, Access Ramp and Tower Erosion Repair, IA, located in Section 10, Township 91 North, Range 49 West, Plymouth County, Iowa.

Our office has completed an Approved Jurisdictional Determination (AJD) concerning your project area and we determined that there are no Waters of the United States within your project area. As there are no Waters of the United States present within your project area, provided you do not impact the Big Sioux River, which is just outside your project area, your project does not require a Department of the Army (DA) permit. The enclosed exhibit entitled, “Fort Randall – Sioux City, Iowa, Access Ramp Over Existing Dike After Structure 103/4 Details, dated February 4, 2021” shows the area for this AJD.

This letter contains an AJD for the subject site. If you object to this jurisdictional determination, you may request an administrative appeal under Corps regulations found at 33 CFR Part 331. Enclosed is a Notification of Appeal Process (NAP) fact sheet and Request for Appeal (RFA) form. If you request to appeal this approved jurisdictional determination, you must submit a completed RFA form to the Mississippi Valley Division Office at the following address:

Regulatory Appeals Review Officer US Army Corps of Engineers Mississippi Valley Division (CEMVD-PD-OD) 1400 Walnut Street, Vicksburg, MS 39180

In order for an RFA to be accepted by the Corps, the Corps must determine that it is complete, that it meets the criteria for appeal under 33 CFR Part 331.5, and that it has been received by the Division Office within 60 days of the date of the NAP.

REPLY TO

ATTENTION OF

-2-

It is not necessary to submit an RFA form to the Division Office if you do not object to the approved jurisdictional determination contained in this letter.

You are advised that this determination for your project is valid for five years from the date of this letter. If the project is not completed within this five-year period or your project plans change, you should contact our office for another determination.

Should you have any questions, please contact our Regulatory Division by email, letter, or telephone Alex Meincke at alexander.c.meincke@usace.army.mil or 309/794-53268.

Sincerely, Alex Meincke Project Manager, Western Branch Regulatory Division
