About this file
This document is Executive Order 2019-12D issued by Ohio Governor Mike DeWine, governing the expenditure of public funds for offshore services. The order, signed on March 4, 2019, prohibits all State Cabinet Agencies, Boards and Commissions from entering into contracts for services provided outside the United States, including both direct purchases and subcontractor services. The order requires service providers to disclose locations where services will be performed, where state data will be accessed or stored, any shifts in service locations, and principal business locations for contractors and subcontractors. The order expires ten calendar days after the Governor's last day in office unless rescinded earlier.
The order includes specific exemptions for services necessary to attract jobs and business to Ohio, academic and educational services supporting international missions of Ohio public institutions, and situations deemed emergencies by the Director of Administrative Services. The Department of Administrative Services, through Ohio's Chief Procurement Officer, must maintain procedures ensuring all agency procurement officers (APOs) include standard contract language reflecting these requirements. Proposals lacking required affirmations and disclosures or proposing offshore services will not be considered. The order establishes that the Director of Administrative Services may grant waivers in certain circumstances.
