B. Pursuant to Executive Order 2021-06, Worker Protection and Investment (October 21, 2021), the Commonwealth is responsible for ensuring that every Pennsylvania worker has a safe and healthy work environment and the protections afforded them through labor laws. To that end, Contractors and grantees of the Commonwealth must certify that they are in compliance with all applicable Pennsylvania state labor and workforce safety laws. Such certification shall be made through the Worker Protection and Investment Certification Form (BOP-2201) and submitted with the bid, proposal or quote. Failure to submit a completed Worker Protection and Investment Certification Form may render your submission non-responsive.
III. CONTRACTOR TASKS:
The following tasks must be completed in performance of the contract:
Project is to be completed as soon as possible in favorable conditions, as determined by the District Forester, but not to exceed June 30, 2022.
A. Supply of 400 tons of TSA
Deliver and dump 400 tons of TSA as outlined below.
1. TSA Material:
❑ All material must be certified to not degrade the environment nor create health hazards.
❑ Aggregate must originate from a PennDOT qualified quarry source. Quarry source must be approved for the production of C2A, as listed in PennDOT Bulletin 14.
❑ Wearing course material must be structurally durable so that weathering and traffic loads do not result in creation of dust, sediment, or pollution.
❑ All trail surface aggregate is to be derived from natural stone formations.
❑ Stone is defined as rock that has been crushed; rock is defined as consolidated mineral matter.
❑ All components of the aggregate mix are to be derived by crushing parent rock material.
❑ For use in this program, both are restricted to that which has been mined or quarried from existed geologic bedrock formations.
❑ The fines passing the #200 sieve must be rock material. No clay or silt soil may be added. Limestone material passing the #200 sieve may be used to make up a deficit in the distribution of sandstone aggregate rock, and vice versa. All added material passing the #200 sieve must be derived from rock material that conforms to program specifications. Lime kiln dust and cement kiln dust may be added to DSA to account for up to 50% of the fines passing the #200 sieve. The amount of particles passing the #200 sieve will be determined using the washing procedures specified in PTM No. 100. Note: The required amounts and allowed ranges, determined by % weight, for various size particles are shown on page 1 of the certification.
❑ The required amounts and allowed ranges, determined by weight, for various size particles are:
Passive Sieve Lower Percentage High Percentage
1/2 inch 100% --
3/8 inch 96% 100%
#4 75% 90%
#8 55% 75%
#16 35% 50%
#200 12% 20%
❑ LA Abrasion - The acceptable limit as measured by weight loss is “less than 40% loss”. Los Angeles Abrasion test, AASHTO T-96 [ASTM C 131] will be used to determine this property. Existing data obtained from tests made for and approved by PennDOT will be accepted.
❑ Plasticity Index - Material must not exceed Plasticity Index (PI) rating of 6. The laboratory test required for these results is the ASTM D4318 - Standard Test Method for Liquid Limit, Plastic Limit, and Plasticity Index of Soils.
❑ Aggregate must be within the range of pH 6- pH 12.45 as measured by EPA 9045C.
❑ Optimum Moisture - Material is to be delivered and placed at optimum moisture content (+/-1%) as determined for that particular source. The optimum percentage moisture is to be determined using Proctor Test ASTM D698, procedure C, Standard.
Contractor must provide an executed and signed TSA Certification form with the Contractor’s solicitation response. This form must list the quarry source and certifies that the aggregate shipped to this specific job site will meet DCNR Specifications and Requirements as outlined on the form and within this Statement of Work.
2. TSA Delivery:
❑ Upon receipt of a Purchase Order, Contractor must begin delivery upon five days advance verbal notification.
❑ A properly executed TSA Certification Form is to be provided at the time of initial delivery and subsequent certification forms should quarry conditions change.
This Certification Form is to apply to the specific stockpile of TSA material being delivered from the Contractor’s source. The form certifies that the TSA material meets all the specifications and requirements referenced below.
❑ Forest district staff and/or their designated representatives, must perform quality assurance / quality control visits to the quarry to inspect the TSA for the project.
This may include the testing of the TSA by DCNR and/or their designated representatives. The Contractor must provide transportation or escort the staff to the TSA load site over the duration of the project.
❑ Material to be delivered at Route 6 and Route 362 intersection under the route 6 bridge. Access will be at the Marsh Creek Access. (Refer to attached Project Map).
❑ Delivery must be at a rate of 500 tons per day.
❑ No material is to be delivered before 7:00 a.m. or after 4:30 p.m.
❑ Tarps are to be used to cover 100% of the load’s exposed surface from the time of loading until immediately before dumping. This requirement includes standing time waiting to dump.
❑ Delivery will continue on an uninterrupted basis.
B. The Supply and the Deliver, Paver-Place and Rolling combined total of 1,800 tons of 2A Limestone:

The decision to both request references or reject bidders based on inadequate reference will be made solely at the discretion of the DCNR.
V. LIQUIDATED DAMAGES:
If any item is not delivered or performed within the contract specified time limits, the delay will interfere with the proper implementation of the Commonwealth’s programs and utilizing the item, to the loss and damage of the Commonwealth. From the nature of the case it would be impractical and extremely difficult to fix the actual damage sustained in the event of any such action.
The Commonwealth and the Contractor, therefore, presume that in the event of any such delay the amount of damage which will be sustained from a delay will be $5,000.00 per day per item, and they agree that in the event of any such delay, the Contractor shall pay such amount as liquidated damages and not as a penalty.
The Commonwealth, at its option, for amounts due the Commonwealth as liquidated damages, may deduct such from any money payable to the Contractor or may bill the Contractor as a separate item. The Commonwealth shall notify the Contractor in writing of any claims for liquidated damages pursuant to this paragraph before the date the Commonwealth deducts such sums from money payable to Contractor. Delivery of an item, which is rejected by the Commonwealth, shall not toll the running of the days for purposes of determining the amount of liquidated damages.
