About this file
The document is a Request for Proposals (RFP) issued by the Town of Breckenridge, Colorado, seeking a Construction Management General Contractor (CM/GC) for the Ballfield Pavilion Project. The project involves improving the space between two baseball fields at the Breckenridge Recreation Center, with key goals of enhancing accessibility, safety, and connectivity. The project will include demolishing existing structures, regrading the site to meet ADA requirements, rebuilding restrooms and a shade structure, and improving viewing and seating locations. The RFP is structured in two phases: Phase One involves pre-construction services such as attending design meetings, providing cost analysis, and supporting utility relocations, while Phase Two covers the actual construction management. Proposals are due on April 16, 2025, with potential interviews scheduled for April 29-May 1, 2025, and the estimated construction phase is from May 1, 2025, through October 31, 2025.
The RFP outlines detailed pricing and evaluation criteria, with proposers required to provide a comprehensive fee schedule including general conditions, pre-construction services, construction services fees, and change order fees. The town will evaluate proposals based on RFP quality, similar project experience, team qualifications, estimating capabilities, project approach, fee schedule, and references, with a total possible score of 100 points. Insurance requirements include worker's compensation, general liability, and comprehensive automobile liability coverage. The town reserves the right to award the contract to the most advantageous proposal, with the flexibility to not proceed with Phase Two if deemed not in the town's best interest. Proposers must be licensed to operate in Breckenridge, Summit County, and the State of Colorado, and must demonstrate the ability to provide performance and maintenance bonds.

In no event shall any proposer have any redress to the OWNER, be it financial or otherwise, in the event that the OWNER alters this schedule in any way. Prospective proposers are advised to submit all required forms, attachments, insurance certificates, and other information as requested in the RFP. The OWNER shall identify up to three (3) proposers who are considered to be best qualified to perform the work required by the
OWNER.

The OWNER reserves the right to delay making an award as necessary to permit proper study and analysis of all proposals received, to split award on proposals, to reject any or all proposals received, and to make a pre-award survey to determine the capability of any or all proposers. The OWNER reserves the right to reject any or all proposals if it believes there is a sound documented business reason for doing so, and to negotiate matters of Contractor performance, project schedule and other issues not directly related to the proposal price submitted prior to awarding a contract.
The OWNER further reserves the right to cancel the procurement process at any time during the evaluation process if it appears that the proposals received are not suitable for any reason whatsoever.
5. Pre-proposal Conference
There is no pre-proposal conference for this project.
6. Inquiries
Any and all proposers may make inquiries in writing to OWNER at any time prior to Friday March 28, 2025 5:00 p.m. Any written question of a proposer regarding the meaning or interpretation of the RFP, work scope, etc., must be submitted to the OWNER prior to the above-specified date. All clarifications given to any prospective proposer shall be similarly furnished to all prospective proposers in summary form as an addendum to this RFP if the lack of such information could reasonably be considered prejudicial towards uninformed proposers. No technical assistance shall be given by the OWNER to any proposer in preparation of its proposal.
Written inquiries shall only be directed to:

"The information contained on pages ________ shall not be duplicated, used in whole or in part for any purpose other than to evaluate the proposal provided; that if a contract is awarded to this firm as a result of the submission of such information, the OWNER shall have the right to duplicate, use or disclose this information to the extent provided in the contract. This restriction does not limit the OWNER’s right to use the information contained herein if obtained from another source."
All such nondisclosure items specified in the proposal shall be subject to disclosure as provided in Part 2 of Article 72 of Title 24, C.R.S. ("The Colorado Public Records Act") or as otherwise provided by law.
10. Original Proposal

Copying, paraphrasing, or otherwise using significant portions of the work product of another organization when presenting a proposal to the OWNER shall not be permitted. Failure to adhere to this instruction may result in the rejection of the proposal.
11. Investigation of Conditions
All proposers are encouraged to review this RFP carefully and to investigate all conditions involved in the execution of work. The selected firm shall not be allowed additional compensation for items on which it has failed to inform itself prior to the opening of proposals.
12. Withdrawal of Proposal

After proposals are opened as prescribed herein, no proposal may be withdrawn for a period of one hundred and twenty (120) calendar days. Negligence on the part of a proposer in preparing its proposal shall not confer a right of withdrawal after the date proposals are received by the OWNER.
13. Single Proposal Response
In the event that only one (1) proposal is received in response to this RFP, the OWNER may require assistance from the single responsive and responsible proposer in the preparation of a proposal price analysis in order to determine whether the single proposal received by the OWNER is fair and reasonable.
14. Conflicts and Inconsistencies
In the event of a conflict or inconsistency between any of the RFP and attachments, including drawings, specifications, the OWNER shall resolve such conflict or inconsistency and provide written notice of the single interpretation to all known proposers by written addendum.
15. Contract Award
The OWNER maintains the right, but shall be under no obligation, to award a contract to the responsive and responsible proposer whose offer is deemed by the OWNER to be most advantageous to the OWNER as determined by capability, qualifications and other factors set forth herein. Proposers are hereby advised that contract award is subject to approval by the OWNER Council.

SECTION II: SCOPE OF SERVICES
1. Background
The Ballfield Pavilion project area is the space between the north and south baseball fields at the Breckenridge Recreation Center. Previous projects completed at the baseball fields includes turf replacement with artificial turf to extend the season that the fields can be used (anticipated use is March through November) and LED lighting conversion for on-field lighting. With the completion of the work to extend the fields’ playing season and make them more sustainable with reduced water and electricity consumption, the remaining component is to make the space between the two fields accessible to all individuals wanting to enjoy it playing sports, viewing, gathering, playing on the playground, and making a safe connection between the Recreation Center to the recreation path.
The Pavilion project scope is to improve the space between the two baseball fields from the recreation path to the east to the parking lot to the west. It involves demolishing the existing restroom and pavilion structure, regrading the site to meet ADA requirements, rebuilding a restroom and shade structure, and improving the viewing and seating locations.
The key project goals are to improve accessibility, safety, and connectivity:
Accessibility: In seeking to host more games in this space, accessibility and meeting Americans with Disabilities Act (ADA) guidelines has become a top priority. Currently, the space between the two baseball fields has multiple levels and uneven steps and the restrooms are not ADA compliant.
Safety: Providing a vehicle drop-off space.
Connectivity: This project seeks to provide improved connections to the ballfields and amenities from both the Blue River Recreation Path and Rec Center parking lot with improved pathways, signage, and widening of the entry points into the space.
See attached design drawings and specifications for additional project information and details.
2. Summary of Work Required
The Town of Breckenridge desires to contract with a reputable experienced contractor to perform pre-construction services and construction management of the project.
Phase One: Phase One is Pre-Construction services. Pre-construction services include, but are not limited to:
1. Attending Design Team bi-weekly meetings with the design team and Owner.
2. In an effort to make the construction phase as efficient as possible the Contractor will be expected to be actively engaged in the design process and will be expected to make recommendations and suggest alternatives as appropriate.
3. Providing cost analysis of the project utilizing the 90 % design drawings.
4. Providing support for coordination of utility relocations.
5. Providing input on pre-ordering of long lead construction items.
Phase Two: Phase two is the construction management of the project. This phase will be the construction of the project as designed and estimated in Phase One. If this phase moves forward the Town and Contractor will enter into a unit price guaranteed maximum price, or other agreed upon method, construction contract. The Town may determine that it is not in its best interest to continue with Phase Two. The Town reserves the right to not enter into a contract with the contractor.
