1. GENERAL: This Performance Work Statement (PWS) outlines the requirements to provide Solid Waste Removal services to Bagram Airfield (BAF), Afghanistan.

1.1 Description of Services/Introduction: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform solid waste removal services as defined in this PWS, except for those items specified as government furnished property and services in Part 3 of this PWS. Food and billeting will not be provided to the Contractor.

The Contractor shall obtain all licenses/permits including but not limited to Government of the Islamic Republic of Afghanistan (GIRoA) required business permits and GIRoA National Environmental Protection Agency (NEPA) required waste permits, approvals, notifications, and other documentation necessary to properly conduct the services in this contract, at no additional cost to the United States Government (USG).

1.2 Background: Open burning of solid waste is commonly used during contingency operations as an expedient way to reduce the volume of solid waste generated until other more environmentally preferable methods can be employed. United States Central Command has regulated that bases in Afghanistan with a population exceeding 100 personnel for more than 90 days shall cease operation of burn pits. This contract provides a means for BAF to manage its solid waste in accordance with the Army and DoD regulations and directives.

1.3 Objectives: The Contactor shall perform the following services:

1.3.1 Pickup solid waste at BAF daily or at such intervals as specified by the Contracting Officer (KO) or the Contracting Officer’s Representative (COR) to prevent accumulation of refuse. Contractor shall pick up solid waste (as defined in the Overseas Environmental Baseline Guidance Document (OEBGD)), including but not limited to recyclables, compost materials, and WWTP (wastewater treatment plant) sludge from designated areas at BAF. This includes the SWMC (Solid Waste Management Complex), the overflow area where solid waste has been staged for removal, the WWTP, and the debris field adjacent to the ASP. The KO or COR may designate other areas of pickup, as necessary.

1.3.2 Transport and dispose of solid waste in accordance with all applicable GIRoA laws, rules, and regulations.

1.3.3 Record and report daily volume of all solid waste picked up and transported under this contract. Record and report daily weight of solid waste picked up from the SWMC. Overflow area waste will not be weighed, but volumes shall be estimated. Record the daily volume of sludge removed from the wastewater treatment plant.

1.3.4 Compile and report monthly a Contractor performance self-assessment certification report, complete with solid waste disposal records that demonstrate that the solid waste is being disposed of in an environmentally sound and legal manner consistent with contract requirements.

1.4 Scope: This contract is to provide solid waste pick up and removal services at BAF, Afghanistan. Solid waste to be removed will be staged at one main location (as specified) on BAF referred to as the Solid Waste Storage Area (SWSA). There will also be an alternate area to support heavy overflow from deconstruction waste. The Contractor shall be responsible for making all arrangements for safe and sanitary removal and transportation of solid waste from BAF in an environmentally responsible manner in accordance with all applicable regulations of GIRoA and local laws, regulations or requirements. The Contractor shall provide all tools, equipment, and personnel necessary to safely load, remove and transport solid waste from BAF to the point of disposal, except for those items specified in Part 3 as Government furnished property, equipment and services. This plan is primarily focused on what the USG must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum level of acceptable performance.

1.6.2 Place of Performance: The work to be performed under this contract will be performed at BAF.

1.6.3 Periodic Progress Meetings: The KO, COR, and other USG personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings, the COR will apprise the Contractor of how the USG views the Contractor's performance. 4.10 SYSTEM FOR INSTALLATION ACCESS TO MILITARY INSTALLATIONS, BASES, AND

PROJECT SITES IN AFGHANISTAN (APR 14)

1. U.S. and NATO Commanders have an “inherent authority” to maintain law and order, security, and discipline necessary to protect the inhabitants of military installations. This authority allows commanders to control access and administration to a military installation and to bar contractors (business entities) and any/all contractor employees from a military installation. A commander’s inherent force protection (FP) authority is independent of an agency’s contracting authority.

2. The vendor acknowledges, by submitting a proposal/offer, that the work requires the prime contractor and all sub-contractors to have access to a U.S. and/or NATO military installation.

3. Contractors and sub-contractors are required to register for installation access in the Joint Contingency Contracting System (JCCS) or the Joint Contingency Interagency Installation Access System (JCIIAS);

whichever is operational at the time of proposal submittal. Upon activation of the JCIIAS, Vendors may verify their registration and installation access status at https://www.jccs.gov/OLVRCAC/bta_jccs_login.aspx by selecting the JCIIAS module and logging in with their user name and password.

a. Contractors and subcontractors that have “registered” and obtained a “pending installation access” or an “approved for installation access” status will be authorized access to U.S. and NATO military installations [and project sites] in Afghanistan.

b. Contractors and subcontractors who have a “registered” status and a “barred from installation access” status in JCIIAS will not be authorized access to U.S. and NATO military installations [or project sites] in Afghanistan.

(1) Contracting officers may not award contracts to contractors who require but do not have the ability to access the work site. Contracting officers may terminate contractors when contractors lose the ability to access the work site.

(2) Contractors must direct subcontractors who have been barred to immediately withdraw from military installations. A prime contractor that fails to take immediate action to remove a barred subcontractor may be terminated for cause or default.

4. A U.S. or NATO Commander’s FP installation access determination is completely unrelated to contracting regulations regarding suspension and debarment authority. Contractor queries related to U.S. installation bar actions must be directed to the USFOR-A Provost Marshal. Contractor queries related to NATO installation bar actions must be directed to the ISAF Joint Command Provost Marshal.

5. Definitions:

a. “Approved for Installation Access” means evaluation of the vendor’s registration indicated it was accurate and complete, and the commander has authorized installation access to U.S. and coalition military installations, bases, and project sites in Afghanistan.

b. “Registered in the System for Installation Access” means the vendor has entered all mandatory information outlined in the JCIIAS vendor registration instructions, including but not limited to:

providing corporate and financial information, identification and classification codes, company point of contact information, and affirmation the vendor has received registration confirmation for its firm and all sub-contractors. A “registered” status means all mandatory fields have been validated as complete.

c. “U.S. military installation” means a base, camp, post, station, yard, center, or other activity under the operational control of the Secretary of a military department or the Secretary of Defense, without regard to the duration of operational control.

d. “NATO military installation” means a base, camp, post, station, yard, center, or other activity under the operational control of a NATO Commander, without regard to the duration of operational control.
