This is a Request for Proposal (RFP) issued by the Birmingham-Jefferson County Transit Authority (BJCTA) for the construction of a Compressed Natural Gas (CNG) Fueling Facility located at 973 Forestdale Boulevard, Birmingham, Alabama 35214. The project involves selective demolition of existing structures, construction of a CNG fueling station with canopy, a service/administrative building (approximately 1,750 square feet, Type IIB construction), equipment yard, and associated sitework. The facility must be fully functional and operational upon completion. A non-mandatory Pre-Proposal Conference is scheduled for Thursday, October 22, 2026, at 10:00 a.m. (CST), available both in-person at BJCTA Headquarters (1801 Morris Avenue, Board Room, Birmingham, Alabama 35203) and virtually. The deadline for submitting written questions is Thursday, November 5, 2026, at 3:00 p.m. (CST), with BJCTA responses posted by Wednesday, November 11, 2026, at 5:00 p.m. (CST). Proposals must be submitted electronically through the BJCTA PlanetBids Vendor Portal no later than 2:00 p.m. (CST) on Thursday, November 19, 2026. The contract period is 365 calendar days from the Notice to Proceed, with anticipated Board approval on Thursday, December 17, 2026.
Each proposer must submit a 5% Bid Bond (not to exceed $10,000) with its proposal and, if selected, provide Performance and Payment Bonds equal to 100% of the contract sum. The evaluation process utilizes a best-value methodology with proposals scored on 100 total points: technical evaluation (60 points) and price evaluation (40 points). Technical evaluation criteria include relevant CNG/comparable construction experience and past performance (15 points), technical approach and project understanding (15 points), key personnel and management approach (10 points), project schedule and risk mitigation (10 points), quality assurance and safety (5 points), and subcontractor coordination (5 points). Price represents the single most heavily weighted individual factor at 40 points. Proposers must possess an Alabama General Contractor license, demonstrate bonding capacity, provide proof of authorization to conduct business in Alabama, comply with E-Verify/immigration requirements, submit federal certifications, and provide evidence of insurance capability. The project is funded with federal financial assistance and subject to Davis-Bacon wage requirements, federal civil rights requirements, and DBE nondiscrimination provisions under 49 CFR Part 26, though no contract-specific DBE goal has been established. Proposers must include at least three references from comparable projects with particular preference given to CNG fueling facility experience.

Each bond shall be issued by a surety authorized and qualified to conduct surety business in the State of
Alabama and acceptable to BJCTA and shall name the Birmingham-Jefferson County Transit Authority as obligee.
Failure of the successful Proposer to timely provide the required bonds or otherwise satisfy the conditions for Contract execution may result in withdrawal of the intended award, enforcement of applicable proposal-security remedies, or other action available to BJCTA under the RFP, applicable law, and the Contract
Documents.
The Performance Bond and Payment Bond are separate from the Proposal/Bid Bond and are not required to be submitted in executed form with the Proposal unless expressly stated otherwise.

SECTION 00 0100 - INSTRUCTIONS TO PROPOSERS
A. Drawings and general provisions of the Contract, including the General Conditions, Supplementary
Conditions, Division 01 General Requirements, Federal Contract Requirements, and other Contract
Documents, apply to this Section.

B. Proposers shall examine and comply with all requirements of the RFP, Drawings, Specifications, Addenda, Proposal Forms, Federal Contract Requirements, and other documents comprising the solicitation.
C. BJCTA intends to award a construction Contract to the responsible Proposer whose Proposal is determined to be most advantageous to BJCTA, price and other evaluation factors considered, in accordance with the evaluation criteria stated in the RFP and subject to all required approvals.
1.02 Scope And Price Proposal
A. Each Proposer shall submit a complete Price Proposal for construction of the MAX Forestdale CNG
Station Project at the Project location identified in the Contract Documents.
B. The Price Proposal shall include all labor, supervision, materials, equipment, tools, transportation, permits, bonds, insurance, overhead, profit, testing, commissioning, temporary facilities, coordination, closeout, warranties, and incidental costs necessary for complete performance of the
Work except where the Contract Documents expressly provide otherwise.
C. Proposers shall coordinate their Technical and Price Proposals with all requirements of the Drawings, Specifications, Contract Documents, and Addenda.
D. Any proposed exception, qualification, assumption, or deviation shall be clearly identified on the
Proposal Exceptions/Deviations Form. Failure to identify a proposed exception shall constitute the
Proposer's agreement to comply with the applicable requirement, subject to the final executed
Contract.
1.03 Pre-Proposal Conference and Site Visit
A. BJCTA will conduct a non-mandatory Pre-Proposal Conference at the date, time, and location identified in the RFP Procurement Schedule. Virtual participation may be available as identified in the solicitation.
B. The Pre-Proposal Conference is intended to provide prospective Proposers with information concerning the Project and procurement procedures. Attendance is encouraged but is not a prerequisite to submission of a Proposal unless BJCTA expressly provides otherwise by Addendum.
C. Statements made during the Pre-Proposal Conference shall not modify the RFP or Contract
Documents. Any material interpretation, clarification, or modification will be issued only through a written Addendum by BJCTA Procurement.
1.04 Proposal Security
A. Each Proposer shall provide proposal security in the form and amount required by applicable
Alabama Public Works Law and this RFP.
B. The proposal guaranty shall be payable to the Birmingham-Jefferson County Transit Authority and shall comply with applicable requirements of Ala. Code §39-2-4.
C. For electronic Proposal submission, the Proposer shall upload a scanned copy of the required proposal guaranty through PlanetBids and shall provide the original security in the manner and by the deadline stated in the RFP.
D. Failure to provide required proposal security may result in rejection of the Proposal when required by applicable law or the material requirements of this solicitation.
E. The successful Proposer shall furnish the Performance and Payment Bonds required by the Contract
Documents as a condition of Contract execution. Performance and Payment Bonds are separate from proposal security and are not required to be submitted in executed form with the Proposal unless expressly required by the RFP.

D. Proposals received after the established deadline will not be accepted except as otherwise permitted by applicable law and BJCTA procurement procedures.
E. Proposals shall remain firm and available for acceptance for one hundred twenty (120) calendar days following the Proposal Submission Deadline unless extended by written agreement.
F. Because this procurement is being conducted through competitive proposals, Proposals will not be publicly opened and Proposal prices will not be publicly read aloud at the submission deadline.
1.06 Evaluation and Selection
A. BJCTA will evaluate Proposals only according to the evaluation factors and relative importance disclosed in the RFP.
B. The evaluation may include review of:
• Technical approach and understanding of the Project;
• Relevant CNG and comparable construction experience and past performance;
• Key personnel, Project organization, and management approach;
• Project schedule, construction sequencing, and risk mitigation;
• Quality assurance/quality control, safety, testing, commissioning, and closeout approach;
• Price Proposal; and
• Responsibility and other mandatory requirements identified in the RFP.
C. BJCTA may evaluate certain mandatory requirements on a Pass/Fail basis separately from scored evaluation factors.
D. BJCTA may conduct reference checks and responsibility investigations and may request clarification or additional information as permitted by the RFP.
E. If BJCTA determines discussions are necessary, BJCTA may establish a competitive range consisting of the Proposers having a reasonable opportunity for award based upon the evaluation factors stated in the RFP.
F. If discussions are conducted, BJCTA will conduct them in accordance with its established procurement procedures and applicable federal requirements. BJCTA may request revised Proposals or Best and Final Offers from Proposers remaining in the competitive range.
G. BJCTA reserves the right to make award based upon initial Proposals without discussions. Proposers should therefore submit their best Technical and Price Proposals initially.
H. Award, if made, will be made to the responsible Proposer whose Proposal is determined to be most advantageous to BJCTA, price and other disclosed evaluation factors considered, subject to applicable law and required BJCTA approvals.
1.07 Price Proposal Evaluation and Price Reasonableness
A. BJCTA will evaluate the Price Proposal in accordance with the evaluation methodology disclosed in the RFP.
B. BJCTA will perform the cost or price analysis required by applicable federal procurement requirements before Contract award.
C. BJCTA may compare proposed prices with the Independent Cost Estimate, competitive Proposal prices, historical pricing, published market information, or other appropriate data in determining price reasonableness.
D. BJCTA may request information reasonably necessary to evaluate price or cost when adequate price competition does not exist or when otherwise required to establish price reasonableness.
E. Materially unbalanced pricing may be considered in BJCTA's evaluation where the pricing creates unacceptable cost or performance risk to the Authority.
F. Proposers shall not be required to submit certified cost or pricing data unless BJCTA determines such information is required and requests it in accordance with applicable requirements.
1.08 Examination of Contract Documents and Project Site
A. Each Proposer is responsible for carefully examining the RFP, Drawings, Specifications, Contract
Documents, Addenda, available Project information, and observable conditions that may reasonably affect performance of the Work.

C. Submission of a Proposal constitutes acknowledgment that the Proposer has reviewed the solicitation documents and has obtained the information reasonably necessary to prepare its Proposal.
D. Nothing in this Section shall require a Proposer to discover concealed, subsurface, or otherwise unknown conditions that could not reasonably be identified from the information provided by BJCTA or through an authorized site inspection.

C. Approval of a pre-Proposal substitution or equivalent that materially affects competition will be communicated through Addendum when appropriate.
D. A Proposer shall not assume approval of a proposed substitution or deviation unless BJCTA has provided written authorization in accordance with the RFP.
1.11 Protests
Protests concerning this solicitation, evaluation, proposed award, or other procurement action shall be submitted in accordance with BJCTA's established Procurement Protest Procedures.
1.12 Public Records
BJCTA is a public entity subject to applicable Alabama public-records requirements and other applicable federal and state laws governing records and disclosure.
Proposals and other information submitted to or maintained by BJCTA in connection with this procurement or the resulting Contract may constitute public records subject to disclosure as required by applicable law.
A Proposer may specifically identify information it believes is confidential, proprietary, privileged, trade-secret, or otherwise legally protected and shall identify the legal basis for the requested protection.
A blanket designation of an entire Proposal as confidential or proprietary is not acceptable unless supported by applicable law.
A. Proposer's designation shall not be binding upon BJCTA. BJCTA shall determine its disclosure obligations in accordance with applicable law.
Nothing in this Section requires BJCTA to disclose information that is confidential, privileged, security-sensitive, or otherwise exempt from disclosure under applicable law.
1.13 Restrictions on Communication / Cone of Silence
A. From issuance of this RFP through completion of the procurement and award process, Proposers and their representatives shall not communicate regarding this procurement with BJCTA Board members, employees, consultants, the Architect/Engineer, Program Manager, Construction Manager, or other
BJCTA representatives except as expressly authorized in the RFP.

PlanetBids to BJCTA Procurement.
C. Authorized communications include communications occurring through the formal RFP process, including the Pre-Proposal Conference, written questions and responses, presentations, interviews, clarifications, discussions, negotiations, BAFOs, protests, and other communications specifically authorized by BJCTA Procurement.
D. Unauthorized communications may result in rejection of a Proposal or other action permitted by
BJCTA policy and applicable law.
1.14 Federal and State Requirements
A. This Project is funded in whole or in part with federal financial assistance. The successful Proposer shall comply with all applicable federal requirements incorporated into the RFP and resulting
Contract.
B. Applicable requirements may include, without limitation, Davis-Bacon and Related Acts requirements, federal civil-rights requirements, DBE requirements under 49 CFR Part 26, applicable domestic-preference requirements, debarment and suspension, lobbying restrictions, and other provisions identified in the Federal Contract Requirements.
C. No contract-specific DBE goal has been established for this solicitation unless otherwise stated by
Addendum or in the final RFP. The absence of a numerical contract goal does not eliminate applicable DBE nondiscrimination or other requirements.
D. The successful Proposer shall comply with applicable Alabama public-works requirements, licensing requirements, E-Verify/immigration requirements, and other state and local requirements incorporated into the Contract Documents.
E. Where federal, state, local, or Contract requirements overlap or differ, the Contractor shall comply with the applicable requirements as determined under the Contract Documents and applicable law.
1.15 Notice to Proceed
A. Selection, Board approval, Notice of Award, or execution by the Contractor does not authorize commencement of Work.
B. The Contractor shall not commence Work until the Contract has been fully executed by BJCTA and
