It is anticipated that this will be a rare occurrence.
6.2 Application Requirements
___ RFA COVER SHEET AND APPLICATION The RFA Application Cover Page is in the Bid’s COMMBUYS File. The RFA Application Cover Page must be signed by a person who is authorized to sign contracts for the Bidder. The required format and information that must be submitted for the Service Proposal can be found in the Service Proposal Requirements located in the Bid’s COMMBUYS File.
___ Service Proposal. The required format and information that must be submitted for the Service Proposal can be found in the Service Proposal Requirements located in the Bid’s COMMBUYS File.
6.3 File Naming Conventions
Files submitted via COMMBUYS must follow the file naming convention specified below, so each file can be readily identified by Bidder’s name, content, and the applicable contract number. Each Contract that may be awarded under this RFA is assigned a number. 6.4 Page Limits and Attachments
Bidders must adhere to page limits specified in the Application Requirements.
Attachments asked for by DMH are not counted in calculating if the page limits have been exceeded. The Executive Summary and the Table of Contents will not be counted in determining if the page limit for the Service Proposal has been exceeded. All pages more than the stated limits will be removed from the relevant part of a Proposal or Application or otherwise from the end of such.
A List of Permitted Service Proposals Attachments (those that were asked for in the Service Proposal Requirements) is included in the Bid’s COMMBUYS File.
Any attachment that is submitted that is not on the List of Permitted Service Proposal Attachments will be removed and not reviewed.
SECTION 7. REVIEW AND SELECTION PROCESS
For each proposed Contract, DMH will select the Bidder whose Application, in the aggregate, provides the best value to DMH and the Commonwealth.
7.1 Compliance with Submission and Qualification
DMH staff designated by the DMH Central Office Contract Contracts, Administration, Audit and Systems Office will first review each Application Application to determine if the Application satisfies the submission, format and contents requirements set forth in Section 6. Also, as part of the minimum submission review process, it will be determined if a Bidder meets the requirements set forth in Section 3.1 and 3.2. Any Application that does not meet the requirements of Sections 6 or 3 may be considered non-responsive and disqualified without further review. The Review Committee or the Awarding Authority may determine that the non-compliance is nonmaterial and can be readily corrected, or that an alternative proposed by the Bidder is acceptable. In such a case, DMH can seek clarification or allow the Bidder to make minor corrections.
If an Application is disqualified pursuant to this Subsection 7.1, the Bidder will be notified of such in writing and of the reasons why. An Application that meets the requirements will be considered an “Eligible Application Application.”
7.2 Review Process
7.2.1 Review Committees. DMH anticipates it will create a separate Review Committee for each potential Contract to be awarded. Each Review Committee will review all Eligible Applications submitted for the Contract assigned to it. DMH may in the alternative elect to assign more than one Contract to a Review Committee; or to opt to have one Review Committee review the Applications for all the Contracts. The Awarding Authorities (see Subsection 7.3) for the applicable Contract(s) to be reviewed by a Review Committee will appoint the members of the Review Committee. A Review Committee membership can consist of DMH personnel, DMH clients, DMH clients’ family members, and/or other non-DMH personnel.
7.2.2 SBPP Participants Applications Reviewed First. If a SBPP Participant submits an Eligible Application for a Contract, the applicable Committee must first review the Eligible Application (s) of the SBPP Participant(s). If one or more SBPP Participants receive a “Acceptable” or better score on both their Cost Proposal and each category of the Service Proposal, the Contract, subject to Subsection 7.5, will be awarded to the SBPP Participant that submitted the Application the Awarding Authority determines provides DMH with the best value and with which DMH can successfully negotiate a Contract. The Review Committee will review the Eligible Applications of the non-SBPP Participants, if any, only if (a) no Eligible Applications were submitted by an SBPP Participant for the Contract; or (b) the Eligible Applications that were submitted by SBBP Participants failed to receive the specified rating of “Acceptable” or higher on their Cost and Service Proposals, or was disqualified pursuant to Subsection 10.5, and/or DMH was not able to negotiate a Contract with one of the SBPP Participants that did achieve the required ratings.
7.2.3 Evaluation Criteria. A Review Committee will evaluate the Eligible Applications in accordance with the process and criteria set forth in the Evaluation Tool located in the Bid’s COMMBUYS.
7.2.4 Additional Information. In addition to the Bidder’s Application, a Review Committee may consider any relevant information about the Bidder known to DMH. Any additional information that is considered will be noted by the Review Committee in the RFA Evaluation Tool.
7.2.5 Preliminary Reviews. A Review Committee may ask other DMH staff to complete preliminary reviews for certain Application categories. Such preliminary reviews shall be done consistently with all applicable Applications. The reviews shall be documented in writing and shall be included in the procurement file.
7.2.6 Oral Presentations. Subject to 7.2.2, a Review Committee and the applicable Awarding Authority may invite those Bidders whose Applications have been judged competitive and responsive to attend an oral presentation. At that time, the Bidders’ Applications may be discussed and clarified, but not changed in any way. DMH may apply restrictions to the structure and content of the oral presentation, and to instruct the Bidders regarding attendees. Oral presentations will not be open to the public nor to any competitors. Failure of a Bidder to agree to a date and time for an oral presentation may result in rejection of the Bidder’s Application.
The Review Committee, at its discretion, may in lieu of, or in addition to, oral presentations request Bidders to submit written clarification of their Applications.
The Review Committee will send written questions for clarification to the Bidders for the Bidders’ written Application. Clarifications are explanations of what has been stated in the Application and may not be used as an opportunity to submit supplemental information or change a Application unless the Review Committee specifically requests these submissions or changes as part of the clarification of all Applications.
7.3 Recommendation for Award
After a Review Committee completes its evaluation and ranking of all SBPP Participants’ Qualified Applications (and oral presentations), or if appliable, after the review of all Eligible Applications, because a) no Eligible Applications were submitted by an SBPP Participant for the Contract; or (b) no Eligible Application submitted by and SBPP Participant was awarded a Contract purusuant to this Section 7, the Review Committee will make a recommendation for Contract award(s) to the applicable Awarding Authority.
7.4 Selection and Contract Negotiations
Upon receipt of a recommendation from the Review Committee, the Awarding Authority will establish a prioritized list of the Bidders’ Applications for Contract negotiations. The Awarding Authority shall prioritize the Applications based on what they determine demonstrates the best overall value to DMH. The Awarding Authority is not bound by the evaluations given to the Applications by the Review Committee; however, the Awarding Authority must review them and give them some consideration. The Awarding Authority will document within the procurement file their prioritized list of Applications and, if the Awarding Authority does not follow the recommendations of the Review Committee, the reasons why will also be documented in the procurement file.
Contract negotiations will then commence with the Bidder(s) rated highest by the Awarding Authority, if any. Negotiations will occur prior to the decision to formally award a Contract. Negotiations shall be limited to those matters specified in 801 CMR 21.07. The identification of a selected Bidder(s) does not create a contractual obligation on DMH or the Commonwealth until negotiations are successfully completed and a Contract is executed. For more information on Contract negotiations, see OSD RFR - Required Specifications, ‘Best Value Selection and Negotiations’. If DMH is unable to satisfactorily negotiate the terms of a Contract with an initially selected Bidder(s) in a reasonable period, DMH may disqualify that Bidder(s) and begin negotiations with the next appropriate Bidder on the Awarding Authority’s prioritized list.
7.5 Rejection of Applications
The Review Committee and/or the Awarding Authority may disqualify any Application that it deems unresponsive pursuant to 801 CMR 21.06 (10). A Application may be rejected as being unresponsive if:
It receives two or more ratings of poor in any evaluation Category as set forth in RFA Evaluation Tool; or DMH determines, in its discretion, that the Bidder has an interest that may conflict with the performance of services under the RFA.
See also Subsection 7.1.
7.6 Contract Award Decision and Award Notification
To award or not award a Contract is the decision of the applicable Awarding Authority. All Bidders who submitted an Application to the RFA will be notified in writing of the Contract award decision for the Contract on which they bid, and notice will be provided on COMMBUYS.
Pursuant to 801 CMR 21.06(13), no Bidder shall hold any press conferences,or make news releases or announcements concerning its selection or non-selection for a Contract prior to DMH’s public release of said information, or prior to the written approval of DMH. Violation of this Section may be considered grounds for disqualification.

Inclusion on the Master Agreement List does not guarantee that the provider will be awarded a SOW.
8.3 Provider’s Contact Information
It is the Contractor’s responsibility to keep its Contract Manager Information current. If this information changes, the provider must notify the DMH Contract Manager by email immediately, using the address located in the Header Information of the Purchase Order or Master Blanket Purchase Order on
