This is not a solicitation announcement; this is a sources sought notice only. The purpose of this notice is to gain knowledge of potential qualified sources and their business size status relative to NAICS Code 316210; Size Standard of 1,000 employees. Responses to this notice will be used by the Government to form a reasonable expectation that two or more small business concerns owned and controlled by veterans will submit offers and that the award can be made at a fair and reasonable price that offers best value to the United States. Responses to this notice are not considered responses to any potential solicitation announcement.
The Department of Veterans Affairs, Orlando VA Medical Center 13800 Veterans Way, Orlando FL 32827, VHA Network 08 Contracting Office is seeking information concerning possible sources to provide the item described in the following Statement of Work Summary.
The goal of this commodity contract is to provide Safety Shoes/Footwear to the Caribbean VA Healthcare System employees located in San Juan, Puerto Rico. The Government intends to award a single, firm fixed price contract for Safety Shoes/Footwear. The period of performance is for 12 months (base year) with four additional one-year option periods, to be exercised at the Government s discretion.
All interested firms should provide the following information: company size, company name, address, point of contact, phone number, email address, veteran status (VOSB or SDVOSB), capability statement to perform the commodity, and a statement describing whether there is a reasonable expectation an offer/quote will be submitted at a fair and reasonable price that offers best value to the United States. Responses to this notice shall be emailed to: Fernando Defillo, Contracting Specialist, fernando.defillo@va.gov. Telephone responses are discouraged due to the large number of firms being surveyed under this NAICS Code. Responses must be submitted no later than 17 June 2020 at 12:00 PM eastern standard time. This notice is intended to assist the VA in determining sources only. A solicitation is not currently available. If a solicitation is issued it will be announced at a later date, and all interested parties must respond to that solicitation announcement separately from the responses to this announcement. Responses to this sources sought is not a request to be added to a prospective offerors list or to receive a copy of the solicitation.
To be eligible for award, contractors must be registered in the System of Award Management at www.sam.gov. Registration is free and potential offerors are encouraged to visit that SAM website and register as soon as possible to avoid delays should they be selected for a contract award. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6- Streamlined Procedures for evaluation and solicitation for Commercial Items- as Supplemented with additional information included in this notice. This announcement constitutes the only solicitation; Quotations are being requested and a separate written solicitation document will not be issued. FAR 52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR
EXECUTIVE ORDERS--COMMERCIAL ITEMS (OCT 2010) (DEVIATION)
(a) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(a) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(b)
(1) Notwithstanding the requirements of any other clause in this contract, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (b)(i) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

Evaluation
Award shall be made to the vendor based on lowest priced, technically acceptable. Technically acceptability means that the quote meets all of the stated minimum specifications. The Government shall evaluate price for reasonableness.

The Government will in no way be bound to this information if any solicitation is issued. The VA is mandated by Public Law 109-461 to consider a total set-aside for Service Disabled Veteran Owned Small Businesses. However, if there are insufficient Service Disabled Veteran Owned Small Business responses, an alternate set-aside or full and open competition may be determined. No sub-contracting opportunity is anticipated. The North American Classification System (NAICS) code for this acquisition is 316998 (500 employees).
