About this opportunity
The Commonwealth of Kentucky, through the Kentucky Transportation Cabinet (KYTC) Division of Purchases on behalf of the Division of Traffic Operations, is issuing a Request for Bid (RFB) for the procurement of 50 units of 45-foot wood poles classified as CLASS 5 or better and treated with Pentachlorophenol in conformance with Section 820 of the Standard Specifications for Road and Bridge Construction. Bidders must ensure poles are treated either within Kentucky or within reasonable driving distance, with inspection and approval required by the Division of Materials prior to acceptance; poles treated outside a reasonable driving distance require inspection by an independent treated timber inspection company at the vendor's expense, with test reports submitted for approval. Vendors are required to furnish a boom truck and are responsible for unloading all poles at the state storage yard in Frankfort, Kentucky, with these services incidental to the bid price. The master agreement will be established for an initial one-year period with the option to extend for four additional one-year periods with written approval from both the vendor and KYTC Division of Purchases. Evaluation will be based on best value scoring, allocating 95 points to price (lowest bidder receives maximum points) and 5 points to delivery time (shortest delivery receives maximum points), with bids requiring a specific delivery timeframe in calendar days after receipt of a delivery order. The solicitation closing date is May 15, 2020, at 10:00 a.m., with a tentative award date of May 29, 2020; bids must be submitted via mail (USPS, UPS, or FedEx) or email to KYTC.Bids@ky.gov in sealed envelopes or as scanned documents, and all bids remain valid for a minimum of ninety calendar days after the bid closing date.
Vendors must comply with Kentucky resident bidder preference laws and submit required affidavits regarding campaign finance compliance, tax registration, state tax standing, and compliance with boycott restrictions. The contract price is firm for the first twelve months with only one price increase permitted thereafter, based on documented industry-wide price changes and requiring thirty days' advance written notice, while price decreases must be reflected immediately upon vendor notification. This procurement is subject to Federal Highway Administration requirements under Form FHWA-1273, including Davis-Bacon prevailing wage standards, equal employment opportunity obligations, safety and health standards compliance, and certification regarding debarment and lobbying restrictions, as well as the Buy America Clause requiring that steel, iron, and other manufactured products meet domestic sourcing requirements. No specific incumbent vendors or budget values are identified in the solicitation documents; however, the bid evaluation and award structure indicates competitive pricing and delivery performance will drive vendor selection.
