About this opportunity

The Texas Department of Criminal Justice is requesting bids to establish a purchase order for water heaters at Willacy Unit in Raymondville, Texas, with bids due July 21, 2026. Texas procurement preferences apply, including consideration for goods produced or offered by Texas bidders, service-disabled veteran-owned businesses, recycled materials, energy-efficient products, and goods from economically depressed areas; bidders must indicate which applicable preference categories their offerings qualify for on the bid form.

Delivery is required within 30 calendar days of order placement. Unit prices govern in the event of extension errors. Delivery is quoted F.O.B. destination with freight prepaid and allowed unless otherwise stated. Response prices must remain firm for TDCJ's acceptance for 30 days from the response due date.

TDCJ reserves the right to award on the basis of low line-item response, low total of line-items, or any other combination serving the State's best interests, and may reject any and all items or waive minor technicalities at its sole discretion. Pricing and payment framework requires respondents to ensure benefits, pricing, and hourly rates are at least as favorable as those granted to previous clients for similar services, with any more favorable terms offered to other clients thereafter becoming immediately available to TDCJ upon notification. Purchases for State of Texas use are exempt from State Sales Tax and Federal Excise Tax. Respondents are responsible for all taxes resulting from the contract, including federal, state, or local income, sales, or excise taxes.

Responses must be submitted on the specified form before the designated time and date; late or unsigned responses are rejected automatically. All communications regarding the solicitation must be directed in writing to the designated purchaser; respondents are prohibited from contacting user department personnel. The contract is subject to termination for non-appropriation and unavailability of funds beyond the current fiscal year, with TDCJ's fiscal year running from September 1 through August 31. Standard compliance requirements apply, including E-Verify certification, suspension and debarment verification, antitrust affirmation, child support obligation affirmation, cybersecurity compliance, and data security controls.
