About this opportunity
The Commonwealth of Kentucky, through the Kentucky Transportation Cabinet (KYTC) Division of Purchases, is soliciting competitive sealed bids for the procurement of used railroad steel designated for District 6. The solicitation seeks 15,000 linear feet of used railroad rail consisting of 500 pieces of 30-foot segments, specified at 130–136 pounds per linear yard of structural grade material. The procured materials must be delivered to the KYTC District 6 Kenton County Maintenance Storage Facility located at 3923 Madison Pike, Covington, Kentucky 41017. This procurement will be conducted as a multi-step competitive sealed bid process in accordance with Kentucky Administrative Regulations 200 KAR 5:375, also referred to as a reverse auction. The Request for Bid (RFB) was issued on July 12, 2018, with a bid closing date of August 2, 2018, at 10:00 a.m. Bids must be submitted in sealed form to the KYTC Division of Purchases Bid Clerk at 200 Mero Street, 4th Floor, Frankfort, Kentucky 40622. Online bidding is prohibited for this solicitation, and all bidders must submit a signed bid form along with mandatory affidavits affirming compliance with Kentucky campaign finance laws, tax obligations, and statutory debarment and delinquency requirements. Interested parties may direct questions to Sheila Durham at 502-782-3975. An alternative electronic bidding option was also scheduled for August 9, 2018, at 2:15 p.m. ET through eBridge Business Solutions, LLC, with electronic bids to be submitted to jesse.turner@ebridgeglobal.com.
The solicitation includes provisions for resident bidder status and qualified bidder status, with interested bidders required to provide supporting affidavits and documentation to claim such designations, with failure to provide documentation potentially resulting in bidder disqualification or contract termination. All bids are subject to federal compliance requirements established by the Federal Highway Administration (FHWA), including FHWA Form 1273 mandatory contract provisions covering employment practices, Davis-Bacon wage standards, safety protocols, nondiscrimination requirements, and suspension and debarment certifications. Materials procured must comply with the Buy America Clause from the 2012 Standard Specifications for Road and Bridge Construction, requiring that steel and manufactured products incorporated into the project be produced in the United States, with bidders obligated to certify the domestic origin of materials. If electronic bidding through eBridge is utilized, the awarded supplier must pay a transaction fee of three percent (3%) of the final awarded contract price, due upon delivery and payment from the buyer. The Commonwealth reserves the right to reject any or all bids, waive informalities and technicalities, negotiate directly with bidders, or accept the proposal deemed most advantageous to the buyer regardless of price. No specific award value or budget range was disclosed in the procurement documents.
