About this opportunity
The Commonwealth of Kentucky Transportation Cabinet (KYTC) Division of Purchases, on behalf of the Division of Highways District 9, is issuing a Request for Bid (RFB) for the procurement of used railroad rail to be delivered to the Lewis County Maintenance facility located at 88 Commonwealth Road, Vanceburg, Kentucky 41179. The solicitation seeks 100 pieces of 40-foot used railroad rail totaling 4,000 linear feet, with rails measuring 136 pounds or greater per linear yard (or 132RE or greater per the solicitation modification). All rail must be steel, straight, structurally sound, and possess legible manufacturer classification stamps, conforming to the Kentucky Transportation Cabinet 2019 Standard Specifications for Road and Bridge Construction. Vendors must provide rails with holes cut near the end for picking and lifting mechanisms, prepaid delivery to the specified location, and must notify the engineer a minimum of 24 hours prior to delivery. Pricing is the sole evaluation criterion, with award determined on a best value basis and the lowest bidder receiving the maximum 100 points; subsequent bidders will be scored proportionally. Written questions were due by April 17, 2024 at 4:00 p.m. Eastern Time, with bids due electronically through the Kentucky Vendor Self Service (VSS) system at https://vss.ky.gov by April 25, 2024 at 1:30 p.m. Eastern Time. The anticipated award date is April 30, 2024, with delivery required within 15 days of contract award.
Kentucky resident bidders are eligible for reciprocal preference as defined in KRS 45A.490-494 and must submit an affidavit confirming authorization to transact business in Kentucky, Kentucky income tax filing, Kentucky unemployment insurance payments, and active workers' compensation coverage for the prior year. Qualified bidders including Kentucky Correctional Industries (eligible for a 20 percent preference), Kentucky Industries for the Blind, and nonprofit agencies serving individuals with severe disabilities (eligible for a 15 percent preference) may claim additional preference points if accompanied by notarized affidavits. All bidders are required to submit an Annual Affidavit for Bidders, Offerors, and Contractors under KRS 45A.110 and 45A.115, attesting that the contractor has not violated Kentucky's campaign finance laws. No incumbent vendors or specific set-asides for small businesses or disadvantaged vendors are specified in the solicitation. All bids must be submitted electronically through VSS; email and hard copy submissions will not be accepted. The contract is a one-time procurement with no renewal options, and pricing shall be quoted on an F.O.B. Destination Freight Prepaid and Allowed basis, with the vendor responsible for all shipping costs and freight claims. Late delivery penalties of one percent per day apply unless delays result from Commonwealth actions or events beyond vendor control, with payment to be made within 30 working days of receipt of goods and invoice.
