About this opportunity
The Commonwealth of Kentucky Transportation Cabinet (KYTC), Division of Purchases, on behalf of the Division of Highways District 5, is issuing a Request for Bid (RFB) for the procurement of 3,320 linear feet of used railroad rail for Spencer County. The solicitation seeks 83 units of T40' structural grade rails measuring 136 pounds or greater per linear yard, in quantities of 40 linear feet per unit, with a modification allowing acceptance of 132RE or greater rail sections in 39-40 foot lengths. The rail material must be straight and structurally sound and conform to Kentucky Transportation Cabinet 2019 standard specifications. Delivery is required on a weekly schedule to two designated facilities: the KYTC District 5 Henry County Maintenance Storage Facility (368 Port Royal Road, Campbellsburg, Kentucky 40011) and the KYTC District 5 Shelby County Maintenance Storage Facility (555 Old Seven Mile Pike, Shelbyville, Kentucky 40065), with prepaid freight delivered F.O.B. Destination and minimum 24-hour advance notification required. All bids must be submitted electronically through the Kentucky Vendor Self Service (VSS) eProcurement system at https://vss.ky.gov by April 26, 2024, at 1:30 PM Eastern Time, with a written questions deadline of April 18, 2024, at 4:00 PM and Commonwealth responses posted by April 19, 2024, at 4:00 PM. Award will be made on a best value basis with price as the sole evaluation criterion (100 points maximum), with the lowest responsive bid receiving the award and a tentative award date of April 30, 2024. All bids shall remain valid for a minimum of 90 calendar days after the bid closing date, and vendors failing to meet contracted delivery dates will incur a one percent per day penalty deduction from invoices, except for delays caused by factors outside the vendor's control.
Kentucky resident bidders and qualified bidders, including Kentucky Correctional Industries, Kentucky Industries for the Blind, and nonprofit agencies serving individuals with severe disabilities, are eligible for reciprocal and preference scoring adjustments respectively. Vendors must submit an Annual Affidavit for Bidders, Offerors and Contractors (notarized, affirming compliance with Kentucky campaign finance laws under KRS 45A.110 and 45A.115), certification of recycled content compliance, and any required affidavits regarding resident or qualified bidder status with their bids. All supplies are exempt from Kentucky sales and use taxes. Vendors must maintain records retention for three years from final payment and comply with mandatory representations regarding Kentucky tax and employment laws, non-discrimination provisions, ethics compliance, and prohibitions on lobbying. Payment will be made within 30 working days of receipt of goods and invoice, with late payment penalties of one percent per month applied if applicable. No incumbent vendors or budget values are specified in the solicitation documents; however, vendors bear full responsibility for all shipment and freight charges, which should be factored into pricing.
