Each proposal must be accompanied by a bid deposit or certified check equal to five percent (5%) of the proposal amount, or alternatively, a five percent (5%) bid bond executed by a North Carolina-licensed surety company, and a performance bond and payment bond equal to one hundred percent (100%) of the contract price will be required upon award. Bidders must include the Identification of Minority Business Participation form with either Affidavit A or Affidavit B; failure to complete these forms is grounds for bid rejection. The Town of Apex reserves the right to reject any or all bids and to waive informalities.
