About this opportunity

The Virginia Department of the Treasury, Division of Risk Management (DRM) is requesting proposals from private-practice attorneys to serve as counsel to DRM on behalf of local constitutional officers and covered local governments, with proposals due October 12, 2026.

The scope includes representation in litigation arising under the Constitutional Officer and Regional Jail Risk Management Plan (VaRISK), the Virginia Liability Risk Management Plan (VaRISK 2), and the Commonwealth of Virginia Public Liability Risk Management Plan. Counsel will handle all aspects of case defense, including appeals where DRM determines appeal is warranted. Case categories include 42 U.S.C. § 1983 claims, employment law, wrongful arrest and malicious prosecution, civil rights and due process violations, general negligence, and third-party recovery actions on behalf of covered parties. DRM receives claim reports from plan participants, conducts investigation, and assigns counsel when litigation arises.

Representation covers local constitutional officers and local governments across Virginia. The Attorney General has determined that it is impracticable or uneconomical for the Office of the Attorney General to provide representation in suits against local governments or constitutional officers; accordingly, DRM is procuring private counsel under Va. Code § 2.2-1832 et seq.
