About this opportunity
The Commonwealth of Kentucky, through the Finance and Administration Cabinet's Division of Engineering and Contract Administration in conjunction with the Kentucky Energy and Environmental Cabinet's Division of Oil and Gas, is soliciting competitive proposals for orphan well plugging and remediation services under the Kentucky Abandoned Storage Tank and Orphan Well Reclamation Program (KASTOW) Methane Emission Reduction Program (MERP) Phase 3. The procurement covers eight abandoned or orphaned well sites located across Warren, Barren, Grayson, and Henderson Counties, identified by Kentucky Well Permit Numbers 16574, 29605, 32135, 73063, 4724, 14982, 72210, and 14808. Contractors must perform plugging and abandonment operations, environmental remediation, wellsite reclamation, and related work, with deliverables including detailed project work plans, equipment lists, staffing information, cement batch plant plans, TENORM and gas detection meter specifications, and spillage prevention strategies. The Commonwealth will evaluate proposals on a 70-point scale comprising 45 points for pricing (evaluated on a proportional sliding scale where the lowest bid receives maximum points) and 25 points for technical merit, including prime and subcontractor experience (2 points), project history (5 points), equipment adequacy (6 points), work plan completeness (6 points), and past performance with the Division of Oil and Gas (6 points). Written questions must be submitted by May 11, 2026, at 4:00 PM Eastern Time, with the Commonwealth's responses due by May 22, 2026. Proposals are due June 9, 2026, at 3:00 PM Eastern Time, and contract award is anticipated for July 8, 2026, with a substantial completion deadline of 365 calendar days from award and a final completion deadline of one additional year thereafter.
All bids must be accompanied by a bid guarantee of not less than 5 percent of the lump sum base bid, with successful bidders required to furnish 100% Performance and Payment Bonds within five calendar days of award. Contractors must certify that no affiliation exists with parties that previously owned, operated, or abandoned the wells. The contract is structured as a firm-fixed-price engagement with individual site costs, allowing the Commonwealth the right to delete individual sites and adjust pricing accordingly. All work is subject to Davis-Bacon Act prevailing wage requirements, with wage determinations effective January 2, 2026, as well as compliance with the Kentucky Civil Rights Act, Equal Employment Opportunity requirements, and accessibility standards under the Rehabilitation Act of 1973 and the Federal Telecommunications Act of 1996. Liquidated damages of $200 per calendar day apply for delays beyond both substantial completion and final completion dates, and a one-year warranty period is required for all work and materials following final completion. Progress payments will be made in accordance with contract terms, with retainage of up to 10 percent until 50 percent completion, then 5 percent thereafter, and the Commonwealth is not tax exempt, making the winning bidder liable for Kentucky sales and use tax. The specific budget or award value is not disclosed in the solicitation documents provided.
