About this opportunity

The Commonwealth of Kentucky, through the Department for Facilities and Support Services Division of Engineering and Contract Administration in coordination with the Kentucky Energy and Environment Cabinet Division of Oil and Gas, is soliciting proposals for the Kentucky Abandoned Storage Tank and Orphan Well Reclamation Program (KASTOW) Henderson County #002. This Request for Proposal (RFP-20-26, RFB-785-260000020) seeks a qualified general contractor to perform orphan well plugging and remediation services on 25 identified orphan wells located in Henderson County, Kentucky, each identified by Kentucky Well Permit Numbers (1044-WF through 992-WF). The contractor must plug and remediate all wells in compliance with Kentucky General Conditions for General Contractor construction contracts and prevailing wage requirements under the Davis-Bacon Act. Key deliverables include submission of a construction schedule within 15 days of commencement, daily construction reports, photographic documentation, and all technical submittals through the Owner's Document Collaboration System, with substantial completion required within 365 calendar days from contract award and final completion within one additional year. Proposals will be evaluated on a 70-point scale, with 25 points awarded for technical merit (including contractor experience, project history, equipment adequacy, work plan completeness, and past performance with the Division of Oil and Gas) and 45 points for cost, with the lowest responsive bid receiving full cost points and higher bids scored proportionally. Written questions are due by July 28, 2025, with proposals due by August 8, 2025, at 3:00 PM Eastern Time; the Commonwealth will evaluate proposals by August 8, 2025, and award the contract by September 10, 2025.

The contract will be awarded on a firm-fixed-price basis to the most responsive and responsible bidder, with the winning contractor required to furnish a bid guarantee of at least five percent, a 100% Performance Bond, and a separate 100% Payment Bond within five calendar days of award. Contractors must comply with all applicable federal funding requirements under Department of Interior general award terms and conditions, including compliance with 2 CFR Part 200 (Uniform Guidance), Buy America preferences, nondiscrimination requirements, and the Geospatial Data Act. Qualified bidders must possess appropriate certifications and insurance coverage, register with the Kentucky Secretary of State, submit a Kentucky Tax Registration Application, and certify no prior affiliation with well owners or operators; reciprocal preferences for Kentucky resident bidders and preferences for qualified bidders apply per KAR 200 5:410. The contractor shall be responsible for reimbursement of documented TENORM (Technologically Enhanced Naturally Occurring Radioactive Material) disposal expenses plus 10 percent administrative costs upon receipt of satisfactory documentation, while the Commonwealth bears initial special inspection costs. Retainage shall be limited to ten percent of monthly payments until 50 percent completion, then five percent thereafter, with payment processing and dispute resolution governed by the Kentucky General Conditions. No specific award value or budget range is disclosed in the solicitation documentation; Kristi Sharp, Statewide Procurement Manager, serves as the Commonwealth's designated buyer and can be contacted at 502-330-9858 for additional information, with all bids directed to the Division of Oil and Gas, 300 Sower Boulevard, 4th Floor, Frankfort, Kentucky 40601.
