About this opportunity

The Commonwealth of Kentucky, through the Finance and Administration Cabinet's Division of Engineering and Contract Administration, and the Energy and Environment Cabinet's Division of Oil and Gas, is soliciting competitive proposals for the Kentucky Abandoned Storage Tank and Orphan Well Reclamation Program (KASTOW) Grayson County #001 orphan well plugging and remediation project. This firm-fixed-price construction contract involves the reclamation and plugging of 22 abandoned oil and gas wells identified by Kentucky permit numbers located in Grayson County. Contractors must submit individual cost proposals for each of the 22 wells, with the total lump-sum contract amount determined by the sum of all site costs, and must achieve substantial completion within 365 calendar days of contract award and final completion within one year thereafter. Proposals are due August 1, 2025, at 3:00 PM Eastern Time, with written questions required by July 24, 2025; evaluations will be completed by August 13, 2025, and contract award is anticipated on August 27, 2025. Evaluation will be conducted on a 70-point scale, with 25 points awarded for technical merit—including contractor experience, project history, equipment adequacy, work plan completeness, and past performance with the Division of Oil and Gas—and 45 points for cost, with the lowest bid receiving the maximum cost score. All bid submissions must be completed online through the Kentucky Vendor Self-Service system and uploaded to the State's Document Collaboration System at www.stateofkyprojects.com, and must include a signed face of solicitation, signed latest addendum, cost and technical proposals, required affidavits, transmittal letter, Kentucky Tax Registration Application (Revenue Form 10A100), and Certificate of Authority if applicable.

Reciprocal preference for Kentucky resident bidders and preferences for qualified bidders or the Department of Corrections, Division of Prison Industries apply to cost scoring. Winning bidders must furnish a 100 percent Performance Bond and separate 100 percent Payment Bond within five calendar days of award, and all bids must include a bid guarantee of not less than five percent of the lump sum base bid. The contract is subject to 29 CFR 5.5 Davis-Bacon wage requirements, federal Uniform Guidance (2 CFR Part 200) compliance, Buy America provisions for infrastructure projects, and various nondiscrimination and civil rights compliance obligations, with funding provided through the Department of the Interior. Contractors must carry comprehensive insurance including commercial general liability of $1,000,000, and the Commonwealth will retain 10 percent of payments until 50 percent completion and 5 percent thereafter, with progress payments made within 20 business days of architect-engineer approval. If TENORM-impacted metals exceeding twice background levels are discovered, contractors will perform disposal in compliance with state and federal laws and be reimbursed actual documented costs plus 10 percent administrative costs. Liquidated damages of $200 per calendar day will be assessed for delays beyond scheduled substantial and final completion dates, and the successful contractor will be the lowest responsive and responsible bidder.
