About this opportunity
The Commonwealth of Kentucky, Division of Oil and Gas, is issuing Request for Proposal RFP-163-26 to procure construction services for the remediation and abandonment of 15 orphan wells located in Muhlenberg County under the Kentucky Abandoned Storage Tank and Orphan Well Reclamation Program (KASTOW). The selected contractor will be responsible for plugging, reclamation, and full abandonment of identified orphan well sites, with work to be completed on a firm-fixed-price basis. The contractor must provide comprehensive labor, materials, equipment, and all services necessary to achieve substantial completion within 365 calendar days from contract award and final completion within one additional year thereafter, with substantial completion defined by achieving full functionality per contract documents, obtaining governmental authority certificates of occupancy, receiving A-E certification, and completing all commissioning and testing requirements. Technical proposals will be evaluated on a 25-point scale based on prime and sub-contractor experience (2 points), project history (5 points), equipment adequacy (6 points), work plan completeness (6 points), and past performance with the Division of Oil and Gas (6 points), while cost proposals are evaluated on a 45-point scale with the lowest bid receiving 45 points and higher bids scored proportionally lower, for a total of 70 evaluation points. All proposals must include a signed face of solicitation, signed addendum acknowledgment, Kentucky Tax Registration Application, Certificate of Authority from the Secretary of State for foreign entities, Required Annual Affidavit for Bidders, and a notarized transmittal letter submitted through the Commonwealth's eProcurement system at www.vss.ky.gov. The proposal deadline is January 9, 2026, at 3:00 PM Eastern Time, with written questions from vendors due by December 15, 2025, and Commonwealth responses issued by December 19, 2025; contract award is anticipated for February 13, 2026, with evaluation occurring between January 28 and February 13, 2026.
The procurement is subject to all applicable federal and state regulations, including Davis-Bacon Act wage requirements, Buy America provisions for infrastructure projects, nondiscrimination and affirmative action requirements, and Uniform Guidance cost principles. All contractors must comply with federal wage rates as specified in Addendum No. 1 and certify no current or past affiliation with entities that owned, operated, or abandoned the wells being reclaimed. Bid guarantees of not less than 5 percent of the lump sum base bid are required, along with 100% performance and payment bonds due within five calendar days of award; liquidated damages are assessed at $200 per calendar day for delays beyond substantial and final completion dates. The contractor must maintain commercial general liability insurance of $1,000,000 combined single limit with $3,000,000 annual aggregate, automobile liability of $500,000, and workers' compensation per statutory requirements. The Commonwealth is not tax-exempt and the winning bidder is liable for Kentucky sales and use tax. While no specific budget range or award value is identified in the solicitation documents, additional reimbursement is available for TENORM-impacted metals disposal costs exceeding twice background levels, plus 10% administrative costs, upon receipt of satisfactory documentation and manifests.
