About this opportunity
The Commonwealth of Kentucky, Division of Oil and Gas, is soliciting proposals through Request for Proposal RFP-160-26 for construction services related to the Kentucky Abandoned Storage Tank and Orphan Well Reclamation Program (KASTOW) to remediate and abandon nine orphan wells located in Laurel County, Kentucky. The procuring agency is the Kentucky Energy and Environment Cabinet, Division of Oil and Gas, in coordination with the Finance and Administration Cabinet's Division of Engineering and Contract Administration. The scope of work involves the plugging and reclamation of orphan well sites identified by permit numbers 14382, 51834, 53538, 53544, 66506, 79203, 80505, 103801, and N24677, with contractors required to submit detailed cost proposals for each well site and manage reimbursement of Technologically Enhanced Naturally Occurring Radioactive Material (TENORM) disposal costs documented with manifests plus 10% administrative costs. The contract is structured as a firm-fixed price agreement with a substantial completion date of 365 calendar days from award and final completion one year following substantial completion. Evaluation will be conducted on a 70-point scale comprising 25 points for technical criteria (including prime and subcontractor experience, project history, equipment adequacy, work plan completeness, and past Division of Oil and Gas performance) and 45 points for cost, with the lowest bid receiving full cost points. Proposals are due by 3:00 p.m. Eastern Time on January 9, 2026, with proposal evaluation scheduled for January 28, 2026, and contract award anticipated by February 13, 2026. Interested bidders should contact Gina Cavender at 502-573-0140 for additional information, and responses must be submitted through the Kentucky Vendor Self-Service (VSS) system.
Bidders must comply with Davis-Bacon federal prevailing wage requirements under 29 CFR 5.5, with Addendum No. One specifying updated federal wage rates applicable to the project, and must meet all Kentucky procurement statutes and regulations, including nondiscrimination in employment and affirmative action reporting requirements. Contractors are required to obtain Kentucky tax registration and, if applicable, a certificate of authority from the Secretary of State, and must certify no past affiliation with well owners or operators. A bid guarantee of not less than five percent of the lump sum base bid is required, along with 100% Performance and Payment Bonds due within five calendar days of award. Liquidated damages are assessed at $200 per calendar day for delays beyond the substantial and final completion dates. The solicitation documents do not specify a total contract value or budget range, though federal funding is provided through the Department of the Interior with compliance requirements under 2 CFR Parts 180, 200, 1400-1402, and Executive Order 14026 establishing a minimum wage of $17.75 per hour for federal contractors. The Commonwealth reserves the right to reject all proposals, award no contract, request Best and Final Offers, or negotiate with the top-ranked vendor, proceeding to the next highest-ranked vendor if negotiations fail, and may delete individual sites and adjust pricing accordingly at its discretion.
