About this opportunity
The Commonwealth of Kentucky, through the Finance and Administration Cabinet Division of Engineering and Contract Administration on behalf of the Energy and Environment Cabinet and Division of Oil and Gas, is issuing RFP-131-26 for general construction services under the Kentucky Abandoned Storage Tank and Orphan Well Reclamation Program (KASTOW). This firm fixed-price procurement seeks proposals for the plugging, remediation, and site reclamation of eight abandoned orphan wells located in Crittenden and Hopkins Counties, designated as CritHop #001, with individual well permit locations numbered N24703, 22433, 96948, 72753, 11241, 11350, N24987, and N24992. Proposals must include a comprehensive work plan detailing well plugging methodology, site remediation approaches, and reclamation procedures, with the contractor required to provide individual line-item costs for each well location submitted as a lump-sum bid through the Kentucky Vendor Self-Service (VSS) system. The contract will be evaluated on a 70-point technical and cost basis, with 25 points awarded for contractor experience, project history, equipment adequacy, work plan completeness, and past performance with the Division of Oil and Gas, and 45 points allocated proportionally to cost proposals with the lowest bid receiving maximum points. Contractors must demonstrate compliance with Davis-Bacon prevailing wage requirements, possess Kentucky tax registration and Secretary of State registration for foreign entities, and maintain Equal Employment Opportunity provisions. Written questions are due by November 25, 2025, with Commonwealth responses provided by December 3, 2025; proposals must be submitted by December 19, 2025, at 3:00 PM Eastern Time, with evaluation anticipated by January 7, 2026, and contract award expected January 14, 2026. The selected contractor must achieve substantial completion within 365 calendar days from award and final completion within one additional year thereafter, with liquidated damages of $200 per calendar day assessed for delays.
Bidders must submit a 5% bid bond or certified check with proposals and provide 100% performance and payment bonds within five calendar days of award, along with comprehensive insurance coverage documentation. The contractor must certify no past affiliation with parties that owned, operated, or abandoned the wells and agree to reimburse the Division for any TENORM-impacted metals disposal costs plus 10% administrative costs if contamination exceeding twice background levels is encountered during remediation. The contract is anticipated to be funded through the Department of the Interior with associated federal compliance requirements including buy America preferences and cost principles under 2 CFR Part 200. While no specific set-asides for disadvantaged enterprises or small businesses are detailed in the solicitation documents provided, all proposals remain subject to applicable federal and state regulations and nondiscrimination provisions. No incumbent contractor information or specific contract award values are identified in the available solicitation documentation; however, the Commonwealth reserves the right to delete individual well sites from the project scope and adjust the contract price accordingly based on final project requirements and available funding.
