About this opportunity
The Commonwealth of Kentucky Finance and Administration Cabinet, Division of Engineering and Contract Administration, in conjunction with the Kentucky Energy and Environment Cabinet and Division of Oil and Gas, is issuing RFP-125-26 for the Kentucky Abandoned Storage Tank and Orphan Well Reclamation Program (KASTOW) to address orphan well remediation in Lincoln County. This firm fixed-price Request for Proposal solicits construction services for the plugging, abandonment, and reclamation of 18 identified orphan well sites located in Lincoln County. The scope of work includes well assessment, plugging operations, wellhead removal, site restoration, equipment mobilization, cement batch planning, TENORM and gas detection, and wellsite restoration in compliance with state and federal regulations, with the contractor required to achieve substantial completion within 365 calendar days from contract award and final completion within one additional year thereafter. Proposals must be submitted electronically through the Commonwealth's eProcurement System by December 19, 2025, at 3:00 PM Eastern Time, with vendor written questions due by November 25, 2025, and responses to be issued by December 3, 2025. Evaluation will commence January 7, 2026, with contract award anticipated January 14, 2026. Proposals will be evaluated on a 70-point scale comprising 25 points for technical merit—including prime and subcontractor experience, project history, equipment adequacy, work plan completeness, and past performance with the Division of Oil and Gas—and 45 points for cost, with scoring conducted by consensus of the evaluation committee. Bidders must submit a bid guarantee of not less than five percent of the lump sum base bid, and the successful bidder must provide 100% Performance and Payment Bonds within five calendar days of selection. The contractor must comply with all applicable federal, state, and local laws, including Davis-Bacon wage requirements under the Davis-Bacon Act, Equal Employment Opportunity requirements, accessibility standards, and federal grant management standards outlined in 2 CFR Part 200 Uniform Guidance, with liquidated damages of $200 per calendar day assessed for delays beyond the substantial and final completion dates.
Reciprocal preference for Kentucky resident bidders and preferences for qualified bidders or the Department of Corrections Division of Prison Industries apply per KAR 200 5:410, and the Commonwealth is not tax exempt, making the winning bidder liable for Kentucky sales and use tax. The contractor must certify non-affiliation with previous well owners or operators and comply with all campaign finance, nondiscrimination, and affirmative action requirements under Kentucky law. The project is funded through federal sources administered by the Department of the Interior, and the contractor assumes responsibility for TENORM-impacted materials disposal if contamination exceeds twice background levels, with reimbursement at cost plus 10 percent administrative fee upon submission of proper documentation. All project communications, submittals, and documentation must be processed through the Commonwealth's Document Collaboration System, and the contractor must maintain continuous jobsite supervision with a qualified superintendent throughout the performance period. While the RFP documentation does not specify individual contract amounts or total contract value, the cost proposal structure requires bidders to provide lump-sum pricing for each of the 18 well locations, with the division reserving the right to delete specific sites and adjust contract pricing accordingly. The contact for inquiries is Gina Cavender at 502-573-0140, or the Commonwealth Buyer Kristi Sharp, Statewide Procurement Manager, at kristi.sharp@ky.gov.
