About this opportunity

The Commonwealth of Kentucky, Division of Oil and Gas, in conjunction with the Energy and Environmental Cabinet and the Finance and Administration Cabinet, is seeking qualified contractors through a Firm Fixed Price Request for Proposal (RFP-122-23) to plug and remediate 21 orphan wells located in Casey County, Kentucky, as part of the Kentucky Abandoned Storage Tank and Orphan Well Reclamation Program (KASTOW). Contractors must complete all work within 18 months (547 days) of contract award, with final completion occurring one additional year thereafter. The scope of work includes establishing wellbore access, confirming total depth, running cement plugs to protect freshwater zones and coal seams, cutting casing three feet below surface, removing flowlines and associated aboveground infrastructure, detecting and properly disposing of TENORM (Technologically Enhanced Naturally Occurring Radioactive Material) if present, and achieving permanent vegetative cover with effective drainage within one year before final payment. Evaluation will be based on a 70-point technical scoring matrix addressing contractor experience, project history, equipment adequacy, work plan completeness, past performance with the Division of Oil and Gas, and proposal completeness, combined with a 40-point cost evaluation where the lowest bid receives full points and higher bids are scored proportionally lower. Written questions must be submitted by October 13, 2022, at 4:00 PM Eastern Time, with Commonwealth responses issued by October 19, 2022; proposals are due by October 31, 2022, at 3:00 PM Eastern Time, with evaluation beginning November 9, 2022, and contract award targeted for November 18, 2022. Liquidated damages are assessed at $200 per calendar day for delays beyond substantial and final completion dates.

All work must comply with the Davis-Bacon Prevailing Wage Act and federal requirements under the Bipartisan Infrastructure Law, requiring laborers and mechanics to be paid at prevailing wage rates as determined by the Secretary of Labor, with contractors submitting weekly payroll documentation and adhering to all applicable state and federal safety, environmental, and labor standards. Contractors must also comply with Build America, Buy America standards for domestically manufactured materials and provide proof of no past affiliations with well owners or operators. A 5 percent bid guarantee in the form of a bid bond or certified check is required at submission, with the successful bidder furnishing a 100 percent Performance Bond and separate 100 percent Payment Bond within five calendar days of award; Kentucky resident bidders receive reciprocal preference in cost scoring. Costs for TENORM disposal and downhole obstruction removal are reimbursable at documented cost plus 10 percent administrative fees upon submission of proper manifests and documentation, with retainage provisions allowing the Commonwealth to withhold up to 10 percent of payment until 50 percent project completion, then 5 percent thereafter until final completion. The specific total contract value or budget range is not disclosed in the solicitation documents; however, the Commonwealth reserves the right to reject all proposals and to request Best and Final Offers prior to contract award. Payment will be made within 30 working days of invoice receipt or acceptance of goods and services, and the Commonwealth is not tax-exempt, making the winning bidder liable for Kentucky sales and use tax.
