About this opportunity

The Commonwealth of Kentucky Finance and Administration Cabinet, Division of Engineering and Contract Administration, on behalf of the Kentucky Energy and Environment Cabinet, Division of Oil and Gas, is procuring construction and remediation services through Request for Proposal RFP-120-26 for the Kentucky Abandoned Storage Tank and Orphan Well Reclamation Program (KASTOW) Owsley #001 project. The solicitation seeks firm fixed-price proposals for the plugging of 15 orphan wells located in Owsley County, Kentucky, and remediation of wellsites including restoration of access roads. Qualified contractors must submit individual lump-sum costs for each of the 15 specified well sites (identified by KY Well Permit Numbers N16185, N16186, N24391, N24392, N16399, N16625, N16396, N16397, N16398, N16187, 131-E9, N24719, 287-E8, N24761, and N24743) and are required to provide technical proposals demonstrating prime and subcontractor experience, project history, equipment adequacy, work plan completeness, and past performance with the Division of Oil and Gas, with technical proposals scored on a maximum of 25 points. Contractors must achieve substantial completion within 365 calendar days from award and final completion within one additional year, with liquidated damages of $200 per calendar day assessed for unexcused delays. The evaluation methodology scores pricing on a proportional basis with the lowest bid receiving 45 points and higher bids receiving proportionally reduced points. All proposals must be submitted electronically through the Commonwealth's eProcurement System by December 19, 2025, at 3:00 PM Eastern Time, with written questions from vendors due by November 25, 2025, and Commonwealth responses provided by December 3, 2025; contract award is anticipated by January 14, 2026.

All bidders must submit a notarized Required Affidavit for Bidders, Offerors, and Contractors per Kentucky Revised Statutes (KRS) 45A.110 and 45A.115, confirming compliance with Kentucky campaign finance laws and certifying under penalty of perjury that they have no past or present affiliations with parties that owned, operated, or abandoned the wells. Contractors must comply with Davis-Bacon wage requirements, federal funding requirements including 2 CFR Part 200 (Uniform Guidance), trafficking in persons certifications, drug-free workplace requirements, and federal nondiscrimination and Equal Employment Opportunity provisions. A five percent bid guarantee is required at submission, and the successful contractor must provide Performance and Payment Bonds equal to 100 percent of the contract sum, executed by a Kentucky-authorized surety company, within five calendar days of award. The contractor is responsible for all licensing, permits, Kentucky Secretary of State registration (if a foreign entity), and Kentucky tax registration. While no specific contract award value is detailed in the solicitation cover documents, the Commonwealth reserves the right to delete individual well sites and adjust the contract price accordingly; the contractor will be reimbursed for TENORM-impacted metals disposal costs exceeding twice background levels plus 10 percent administrative costs upon receipt of satisfactory documentation and shipping/disposal manifests. Payment will be made within 30 working days of invoice receipt or service acceptance in accordance with Kentucky statute, with retainage withheld at 10 percent until 50 percent completion and then 5 percent thereafter, and a one-year warranty period commencing at Final Completion.
