About this opportunity

The Commonwealth of Kentucky Department of Agriculture, on behalf of Lincoln County, is conducting a competitive Request for Bid (RFB 758 2500000328) for the removal and disposal of agricultural chemical pesticides. The procurement seeks a qualified vendor to provide comprehensive removal and disposal services for concentrated agricultural chemical pesticides (40,000 pounds) and non-hazardous pesticide rinse waters (40,000 pounds), with pricing quoted per pound on an F.O.B. Destination Freight Prepaid and Allowed basis. The contractor must transport waste to EPA-approved incineration facilities at approximately 180-day intervals, with estimated annual quantities of 20,000 to 25,000 pounds from a primary storage site at the Environmental Resources Center at the Marshall County Landfill Facility in Benton, Kentucky, and 12,000 to 13,000 pounds of hazardous waste plus 12,000 to 13,000 pounds of non-hazardous rinse water from secondary sites throughout the Commonwealth. The vendor must provide all materials, supplies, equipment, and labor necessary for collection and transportation, maintain all required manifests and Certificates of Disposal, and submit proper documentation before invoice payment; a one percent per day penalty applies for removals exceeding the 30-day requirement. Evaluation will be based on best value using the following weighted criteria: price (90 points), years of experience in the United States (10 points), and a pass/fail disposal plan for pesticides ineligible for incineration. The vendor question deadline is December 13, 2024 at 10:00 AM ET, with bids due January 7, 2025 at 1:30 PM ET to the address located at 107 Corporate Drive, Frankfort, Kentucky 40601; pricing must remain valid for a minimum of 60 days after the bid due date. Interested parties should contact Stephanie Durr at 502-564-6521 for additional information.

Kentucky reciprocal preference statutes apply to this solicitation, providing preference points to Kentucky resident bidders and qualified bidder categories including Kentucky Correctional Industries (20 percent preference), Kentucky Industries for the Blind, nonprofit corporations under KRS Chapter 163, and qualified nonprofit agencies for individuals with severe disabilities (15 percent each). All bidders must execute required affidavits under penalty of perjury attesting to campaign finance law compliance, and those claiming resident or qualified bidder status must provide supporting documentation demonstrating authorization to conduct business in Kentucky with appropriate tax filings, unemployment insurance payments, and workers' compensation policies maintained for at least one year prior to the advertisement date. The initial contract term is one year from the award date, with four optional one-year renewal periods available, during which no price increases are permitted in the first 12 months. Successful vendors must obtain a Certificate of Insurance with Commercial General Liability coverage of $1,000,000 per occurrence and $2,000,000 aggregate, and Automobile Liability Insurance of $1,000,000 combined single limit if vehicles are used. No incumbent vendor information or budget ceiling is specified in the solicitation documents; the original RFB closed on July 26, 2024 without award, and this modified re-solicitation represents the Commonwealth's second attempt to secure qualified removal and disposal services for this agricultural chemical waste management program.
