Procurement of natural gas outdoor heating unit.

The Texas Department of Criminal Justice (TDCJ) is seeking bids for the procurement of natural gas outdoor heating units. This is a proprietary purchase under Section 2155.067 of the Texas Government Code, so only bids on items conforming exactly to the specified brand name(s) will be considered for award. The solicitation includes detailed terms and conditions, product specifications, delivery requirements, invoicing, and various certifications and affirmations the bidder must provide. Bids will be evaluated based on the lowest line item bid, lowest total of line items, or any combination that serves the state's best interest. The solicitation does not specify the quantity of units required or the contract term, including any renewal options. The response due date and any site visits or bidder's conferences are also not provided.

This is a restricted procurement, with only bids on the specified brand name(s) eligible for consideration. The solicitation does not mention any set-aside designations or restrictions on the types of organizations that can respond. The incumbent vendor(s) and current contract value are not disclosed. The procurement is being funded through the TDCJ's budget, which is contingent on legislative appropriations, and the contract may be terminated if insufficient funds are appropriated.
