About this opportunity

The Maryland Office of People's Counsel, an independent state agency, is requesting proposals for expert consulting and testimony services to support its participation in Potomac Edison Company's electric base rate case (PSC Case Number 9904), with proposals due September 22, 2026 at 5:00 p.m. EST.

The scope encompasses review of Potomac Edison's filing, testimony, exhibits, workpapers, and discovery responses; assistance with discovery and issue identification; development of recommended adjustments and policy positions; preparation of direct, rebuttal, and surrebuttal testimony and exhibits; review of opposing testimony; hearing preparation and attendance with testimony; support for settlement discussions and briefing; and technical analysis to support OPC's public communications regarding the case. The 2021 Legislative expansion of OPC's mandate requires consultants to consider environmental interests and the State's greenhouse gas emissions reduction goals within this rate case work.

OPC will evaluate proposals on Technical Expertise (40%), Quality of Issue or Policy Identification (40%), and Price (20%). No specific contract amount or term is disclosed in the notice due to the litigation-related nature of the work; the sample agreement template indicates the State retains the unilateral right to extend the contract term for up to three additional successive one-year calendar terms at its sole option.

Selected contractors must execute Maryland state affidavits covering campaign contributions, drug policy, tax payment, debarment, and discrimination compliance. The contractor's business must be registered with the Maryland State Department of Assessments and Taxation and, if a corporation or LLC, must be in good standing. All work product — testimony, exhibits, reports, and studies — becomes the sole property of OPC with no restriction on use. Invoices are submitted monthly to invoices.opc@maryland.gov. Proposals must be submitted on firm letterhead signed by an officer, partner, or proprietor to OPC.RFP1@maryland.gov. Questions should be directed to OPC Procurement Officer Sarah DeMaio at Sarah.DeMaio@maryland.gov.
