About this opportunity
The Texas Department of Criminal Justice is conducting a competitive sealed bidding procurement through an Invitation for Bids (IFW245929A) with a submission deadline of April 23, 2026. While specific commodity descriptions and quantities are referenced in supplementary sections of the complete invitation document, the procurement framework establishes that interested bidders must submit proposals to the TDCJ Accounts Payable office located at P.O. Box 4018, Huntsville, TX 77342-4018. All bids must be submitted on the designated form by the specified deadline, with late or unsigned bids automatically rejected. Bidders are required to include Texas Identification Numbers and Federal Employer Identification Numbers, price all items F.O.B. destination with freight prepaid, and ensure all goods are new and unused unless otherwise specified. Bids must remain firm for 30 days from the bid opening date, with unit prices governing in cases of extension errors. TDCJ reserves the right to award based on low line item bids, total bids, or any combination serving the state's best interest. All items must comply with applicable standards, including OSHA requirements for electrical equipment with appropriate UL, FMRC, or NEMA listings, and deliveries must occur within 14 calendar days unless otherwise stated. Material Safety Data Sheets must accompany applicable shipments, and all goods are subject to inspection and testing with costs borne by the vendor if products fail to meet specifications.
The procurement includes a preference consideration under 34 TAC Rule 20.306 that may apply to goods produced or offered by Texas bidders meeting specific ownership criteria. Bidders must certify compliance with numerous statutory requirements including E-Verify system usage, suspension and debarment status, antitrust law compliance, child support obligations, and prohibitions against boycotting Israel, energy companies, and certain foreign entities. Payment shall be made 30 calendar days after the later of invoice receipt, goods receipt, or service completion, with a Net 30 payment term established for successful bids and cash discounts available based on payment terms. Vendors are required to establish direct deposit accounts and submit completed W-9 forms to TDCJ Accounts Payable. The contract is contingent upon legislative appropriation and availability of funds, with TDCJ retaining the right to terminate without penalty if insufficient funds are appropriated. All work products, data, documents, and materials developed during contract performance become the exclusive property of the State of Texas, and vendors must indemnify and hold harmless the State of Texas from all claims arising from their performance, including intellectual property infringement claims.
