About this opportunity
The Commonwealth of Kentucky Finance and Administration Cabinet, on behalf of the Kentucky State Police, issued a Request for Bid (RFB) for chemical munitions procurement to support the Department of Corrections, Kentucky State Police, Kentucky Horse Park, and the Department of Parks. The solicitation seeks bids for approximately 70 line items of less-lethal munitions and related equipment, including 40mm launchers, oleoresin capsicum (OC) aerosol sprays in various formulations and sizes, rubber and foam baton rounds, training kits, tear gas (CS) grenades, smoke devices, and distraction grenades, with estimated annual usage quantities ranging from 2 to 850 units per item. Bidders must submit pricing for the complete catalog of items listed in Attachment A (Chemical Munitions Bid Spreadsheet V2) to be considered responsive, with all pricing quoted F.O.B. Destination Freight Prepaid and Allowed, exclusive of federal excise taxes and Kentucky sales or use taxes. The contract will be awarded on a master agreement basis for an initial one-year term with four optional one-year renewal periods subject to written approval and potential renegotiation. Evaluation will be based on best value using a ranking approach with price weighted at 95 points and delivery performance weighted at 5 points, with the lowest bidder receiving maximum points and subsequent bidders scored proportionally. Vendor written questions were due February 1, 2021 at 10:30 AM EST with Commonwealth responses provided by February 3, 2021; the bid closing date was initially February 12, 2021 at 1:30 PM EST but was extended to February 18, 2021 at 1:30 PM EST. Prices must remain valid for a minimum of 60 calendar days after the bid due date, with price increases prohibited during the first 12 months; thereafter, increases require written justification based on industry-wide price changes, and a one percent consolidated quarterly administrative fee on net sales must be paid to the Commonwealth.
Kentucky resident bidders receive reciprocal preference equal to preferences given by the nonresident bidder's state, and qualified bidders receive additional scoring advantages, including Kentucky Correctional Industries (20% preference) and Kentucky Industries for the Blind and qualified nonprofit agencies for individuals with severe disabilities (15% preference each). All bids must be submitted electronically through the Kentucky eProcurement system, with paper bids not acceptable; bidders are required to be registered with the Kentucky eProcurement System, hold Kentucky tax registration, and submit required affidavits including resident bidder status if claiming such preference. Delivery time must be specific and clearly stated on the bid spreadsheet, with a one percent daily deduction from invoices for each day delivery is delayed beyond the stated timeframe. The solicitation permits bidders to propose either the specified brand-name products or approved alternates from manufacturers including First Defense, Sabre Red, Direct Impact, Safariland, Def-Tech, and Stinger. No specific incumbent vendors or budget ranges were identified in the solicitation documents; however, the estimated annual usage quantities across all 70 line items provide an indication of potential contract value, with significant volumes for certain products such as 447 units of OC aerosol sprays and 850 units of training kits suggesting a substantial procurement.
