About this opportunity

Bernalillo County Purchasing Section is requesting proposals to establish a qualification-based pool of nonprofit organizations eligible to receive capital outlay appropriations, with proposals due September 24, 2026. This is a multi-award vehicle structured to comply with New Mexico's constitutional anti-donation clause (Article IX, Section 14 of the NM State Constitution), which requires that state capital appropriations designated for third-party nonprofits flow through and be owned by Bernalillo County as fiscal agent.

Qualified nonprofits will execute Third Party Agreements with Bernalillo County to undertake designated capital projects. The County's role is fiscal administration and project ownership; funding sources are state capital outlay appropriations that have been designated for specific nonprofit organizations and directed to the County. Offerors must be nonprofit organizations eligible to receive such appropriations under New Mexico law.

Bernalillo County reserves discretion to decline serving as fiscal agent for any capital grant appropriation designated for a nonprofit organization that responds to this RFQ.

Opportunity text

The Bernalillo County ("County") Purchasing Section of the Procurement and Business Services Department ("Purchasing") is requesting proposals for the establishment of qualification-based capital projects solicited by county nonprofit organizations. All Offerors are encouraged to read this Request for Qualifications carefully, especially the mandatory requirements. Funding for projects sought by Bernalillo County nonprofit organizations have come to Bernalillo County government to serve as the fiscal agent and project owner. The State of New Mexico requires that in order to maintain compliance with the anti-donation clause (Article IX, Section 14 of the NM State Constitution), any capital outlay appropriation intended for a third-party nonprofit that comes to Bernalillo County must be awarded to, and administered and owned by, Bernalillo County. Administration of funds involving a nonprofit agency must include a method of procurement when a nonprofit entity is intended to receive the funding, which this Request for Qualification fulfills. It is the intent of the County to issue a multiple award to establish a pool of qualified nonprofit organizations. Qualified nonprofits with designated capital outlay appropriations will enter into Third Party Agreements to facilitate projects that are undertaken. Bernalillo County reserves the right to decline serving as a fiscal agent to a capital grant appropriated to an intended nonprofit organization.
