About this opportunity

The Missouri Department of Transportation (MoDOT) is conducting a Single Feasible Source (SFS) procurement for the MIT-SCAN-T3 Non-Destructive Thickness Measuring Gauge System, a specialized technological solution for measuring asphalt and concrete pavement thickness. MoDOT has determined that Kessler Soils Engineering Products, Inc. is the sole source capable of providing this unique, patented electromagnetic eddy current technology that eliminates the need for destructive roadway coring. The solicitation seeks to procure a system that can accurately measure pavement thickness using proprietary technology not available from any other manufacturer. The procurement process will be conducted electronically through the MissouriBUYS eProcurement system, with responses accepted from July 22, 2024, at 3:00:00 PM CDT through July 29, 2024, at 10:00:00 AM CDT. The contract period will extend from the date of award through June 30, 2025, with delivery terms specified as Free On Board Destination and payment terms set at Net 30 Days. Evaluation criteria will focus on the lowest and best bid that meets all mandatory specifications, with MoDOT reserving the right to reject any and all bids.

While the solicitation is open to all vendors, MoDOT encourages participation from Minority Business Enterprises (MBE) and Women Business Enterprises (WBE), seeking 10% MBE and 5% WBE participation through subcontractors, suppliers, or joint ventures. The procurement includes provisions for a 10% price preference for American-made products on commodity purchases over $25,000, aligning with the Domestic Products Procurement Act. No specific incumbent vendors or existing infrastructure integration requirements are mentioned in the documentation. The solicitation does not provide an estimated total contract value, and no specific set-asides or restrictions limit potential respondents beyond the standard state procurement guidelines. Vendors are invited to contest the single feasible source determination by providing information demonstrating their ability to supply equivalent equipment. The procurement follows Missouri state regulations 7 CSR 10-11.020, which allows for single feasible source acquisitions when supplies are proprietary or only available from a single manufacturer or distributor.
