About this opportunity

The State of Maine Department of Administrative & Financial Services, Office of Employee Health, Wellness, & Workers' Compensation is requesting proposals for legal services supporting the state's self-insured workers' compensation program under RFP 202608133, with proposals due September 23, 2026 and questions due September 11. Maine bar licensure in good standing and professional liability insurance are mandatory eligibility requirements. The state anticipates multiple awards from this RFP.

Counsel will provide legal representation and advice on workers' compensation matters under Title 39-A M.R.S.A. and Workers' Compensation Board rules, including representation before the Board and Maine Supreme Judicial Court on contested claims, legal opinions, discovery and litigation management, coordination with the Attorney General's Office, training seminars on workers' compensation law, and quarterly case updates. The state manages approximately 1,200 claims annually across approximately 12,000 state employees.

The initial contract period runs January 1, 2027 through September 30, 2028, with two optional renewal periods: October 1, 2028 through September 30, 2030 and October 1, 2030 through September 30, 2031. Compensation is submitted as hourly rates in the cost proposal.

Evaluation uses a 100-point scale: Organization Qualifications and Experience (35 points), Proposed Services (35 points), and Cost Proposal (30 points). The lowest submitted cost receives the full 30 points, with other proposals scored proportionally. Bidders must submit three examples of relevant past projects, organizational charts, litigation history for the past five years, and three years of financial statements. All proposals must comply with Maine's data classification and cybersecurity policies, including protections for personally identifiable information classified at HIGH confidentiality impact level. Awarded bidders will execute an IT Service Contract with Confidentiality and Non-Disclosure Agreement and comply with all State IT policies. Proposals are submitted electronically via the Vendor Self Service System.
