About this opportunity
The Commonwealth of Kentucky, through the Department of Fish and Wildlife Resources (KDFWR) and the Finance and Administration Cabinet, issued a Request for Bid (RFB 758 2100000613) for the procurement of Evidential Breath Alcohol Testing Instruments (EBT) on April 22, 2021. The solicitation seeks hand-held breath alcohol testing devices to be used by law enforcement to analyze breath alcohol concentration of subjects prior to arrest, with the KDFWR anticipating the purchase of approximately 75 units annually for delivery to their facility located at #1 Sportsman's Lane, Frankfort, Kentucky 40601. Vendors were required to submit written questions by April 29, 2021 at 10:00 AM ET, with bids due by May 7, 2021 at 1:30 PM ET through the mandatory electronic Kentucky eProcurement system. The contract will be awarded for an initial one-year period with options to extend for four additional one-year periods by mutual written agreement, with pricing quoted on an F.O.B. Destination Freight Prepaid and Allowed basis. Award will be based on best value using a weighted scoring methodology allocating 90 points for price and 10 points for delivery time, with the lowest responsive bidder receiving maximum price points and other bidders scored proportionally. Prices must remain valid for a minimum of 60 calendar days following the bid due date, and no price increases are permitted during the first 12 months of the contract. All bidders must be registered in the Commonwealth eProcurement System prior to submission and must comply with tax registration and Secretary of State requirements before contract award.
Kentucky resident bidders are eligible for reciprocal preference, and qualified bidders including Kentucky Industries for the Blind and nonprofit organizations serving individuals with disabilities receive preference equal to 15 percent of maximum points. All bidders must submit an Annual Affidavit demonstrating compliance with Kentucky campaign finance laws, sales and use tax registration requirements, non-delinquency on state taxes and fees, and certification that they are not engaged in boycotts of persons or entities in jurisdictions with which Kentucky maintains open trade relationships. For non-bid contracts, additional affidavit requirements apply regarding campaign contributions, with limitations on contributions to gubernatorial slates and restrictions on contributions exceeding $5,000 in aggregate to candidates with jurisdiction over the contract. Bidders claiming resident bidder status must provide evidence of Kentucky business authorization, corporate income tax filing, unemployment insurance contributions, and active workers' compensation policies, while those claiming qualified bidder status must demonstrate nonprofit corporation status furthering Chapter 163 purposes or qualified nonprofit agency employment of individuals with severe disabilities for at least 75 percent of direct labor hours. No specific budget range or award value was disclosed in the solicitation documents. For additional information, vendors should contact Keith Srutowski at 502-564-7007.
