About this opportunity

The County of Orange, OC Waste & Recycling, is seeking competitive bids for the importation of solid waste for disposal through a fully electronic solicitation. The contract opportunity allows for the importation of up to 500,000 tons of out-of-county solid waste annually to be disposed of at either the Prima Deshecha Landfill or Frank R. Bowerman Landfill, with potential expansion to 1,000,000 tons pending landfill capacity approval. Bidders must submit electronic proposals through the County's online bidding system by November 15, 2024, at 2:00 pm, with a minimum bid requirement of $82 per ton. The evaluation criteria will focus on the highest bidder, with the most qualified vendor selected to handle the entire 500,000-ton allocation. The initial contract term will run from July 1, 2025, to June 30, 2030, with potential extensions for two subsequent five-year terms. Key objectives include managing waste disposal capacity, supporting the County's waste infrastructure system, and providing a mechanism for accepting limited out-of-county waste.

The procurement includes specific set-aside designations and business preferences, requiring bidders to be certified as a Small Business by the California Department of General Services and maintain their principal center of operations within Orange County. The solicitation supports local businesses by offering preferences for County of Orange Local Small Business (OCLSB) and Disabled Veteran Business Enterprise (DVBE) enterprises. The contract includes an automatic annual rate adjustment based on the Consumer Price Index, with a guaranteed minimum 3% increase if the CPI adjustment is lower. Quarterly payments will be required, representing 25% of the annual contract amount, with potential rate adjustments to reflect new or increased governmental fees. The total potential award value could reach approximately $41 million annually (500,000 tons at $82 per ton), with the possibility of increasing to $82 million if the full 1,000,000-ton capacity is approved. The County reserves the right to reduce or terminate the agreement if in-county waste disposal increases or landfill capacity becomes limited, providing flexibility in contract management.
