About this opportunity

The Kentucky Transportation Cabinet, Division of Purchases, issued a Request for Bid (RFB) on January 9, 2024, to establish a master agreement contract for grout and backer rod materials to be supplied to the Division of Traffic Operations. The procurement seeks 200 bags of 20-pound non-shrink grout, 200 bags of 50-pound non-shrink grout, and 3,000 linear feet of 1/2-inch backer rod supplied on 200-foot reels, all of which must comply with Section 835.19 and 835.20 of the 2019 Standard Specifications for Road and Bridge Construction and be listed on the Kentucky Division of Materials approved materials list. Vendors must submit bids electronically through the Kentucky Vendor Self Service (VSS) system by February 5, 2024, at 1:30 p.m. Eastern Time, with a tentative award date of February 8, 2024. The master agreement will have an initial one-year term with four optional one-year renewal periods, subject to written approval by both parties. Evaluation will be based on best value using two criteria: price (95 points) and delivery time (5 points), with vendors required to specify a firm delivery timeframe in calendar days after receipt of a delivery order; a one percent daily deduction applies to invoices for each day delivery is late. Pricing must be quoted F.O.B. Destination Freight Prepaid and Allowed with the vendor responsible for all shipping charges, and price increases are prohibited during the first twelve months, with only one increase permitted thereafter and must be justified by industry-wide changes.

This procurement is partially funded by Federal Highway Administration (FHWA) Emergency Relief (ER) program funds, requiring vendors to comply with FHWA 1273 clauses, Buy America/Build America, and Buy America Act (BABA) requirements, as well as prohibitions on certain telecommunications equipment. Vendors must be registered with the Commonwealth eProcurement System and comply with all Kentucky statutes related to taxes, sales and use, income, wages and hours, occupational safety and health, unemployment compensation, and workers' compensation. No Davis Bacon wage rates apply as this is a commodity procurement. The solicitation document does not specify set-aside designations for disadvantaged enterprises, incumbent vendors, or budget ranges for the contract award value. The contract may be extended to other state agencies and political subdivisions with vendor consent, and it is governed by Kentucky Revised Statutes KRS 45A and incorporates General Conditions and Instructions for Solicitations and Contracts (FAP 110-10-00).
