About this opportunity
The Texas Department of Criminal Justice (TDCJ) is requesting bids to establish a purchase order for fresh fruits and vegetables to be delivered to the Wynne Food Warehouse in Huntsville, Texas, with bids due October 14, 2026. A preference under 34 TAC Rule 20.306 applies to goods produced or offered by Texas bidders.
The scope encompasses various fresh produce items with delivery required within a specified number of days from order placement. All goods are subject to inspection and testing by TDCJ personnel; vendors bear testing costs if products fail to meet specifications. Product substitutions require written approval from the TDCJ Contracts and Procurement Department. Delivery must occur during normal working hours unless prior approval is obtained; vendors must provide written notice of anticipated delays.
Pricing must be quoted F.O.B. destination with freight prepaid and allowed. Prices are requested to be firm for thirty days from the response due date. Payment terms include potential cash discounts or net 30 day options. Purchases for State of Texas use are exempt from state and federal sales and excise tax; respondents must pay all other applicable taxes. The contract is not exclusive, and TDCJ makes no guarantee regarding quantity or dollar amount of products to be procured.
Responses must be submitted on the prescribed form with unit pricing and time-stamped at the specified office by the deadline; late or unsigned responses will not be considered. Respondents must provide their Texas Identification Number (T.I.N.S.) and Federal Employer Identification Number (EIN). All responses must comply with Texas procurement statutes and regulations, and respondents must certify compliance with E-Verify system usage, absence of debarment, non-involvement in prohibited business practices, and adherence to state policy on boycotts of Israel and energy companies. TDCJ reserves the right to make awards based on low line-item response, low total of line-items, or any combination serving the best interest of the State, and may extend any contract up to three months at its sole discretion.
