About this opportunity

The Dallas Area Rapid Transit Authority (DART) is soliciting bids for filters and air compressor brake system components specifically designated for Wabtec equipment under Contract Opportunity 2098366. This procurement requires submission through the Bonfire registration system, with a bid due date of March 31, 2026. The solicitation mandates that all bids include FOB Destination shipping terms with freight costs incorporated into the overall quoted price. Delivery timeliness is critical to this procurement, as the seller's failure to meet specified delivery schedules constitutes grounds for rejection and default termination of the order. Invoices must be submitted in triplicate to APInvoices@dart.org with detailed documentation including purchase order number, item number, description, sizes, quantities, unit prices, and extended totals. Payment terms are Net 30 from the later of invoice receipt or order receipt date. All supplies must meet merchantable quality standards, be suitable for intended use, and comply with all referenced product descriptions and specifications.

While the available documentation does not specify set-aside designations or disadvantaged enterprise restrictions, potential bidders must meet certain compliance requirements including certification that they are not identified on the Texas Comptroller's list of companies with foreign terrorist organization contracts and that neither the bidder nor its affiliates boycott Israel. The contract is governed by Texas law with venue established in Dallas County. All purchase orders are subject to DART's complete Terms and Conditions, which reserve the right for the Contracting Officer to make changes to the order through written notice, with equitable adjustments to price or delivery schedule available if changes affect the seller's costs or performance timeline. Claims for equitable adjustment must be submitted within 30 days of receiving a change order. No incumbent vendor information, specific budget range, or award value has been disclosed in the available documentation for this procurement.

In such event, the Seller shall be liable for damages, including the excess cost of reprocuring similar supplies or services or completing construction; provided that, if (i) it is determined for any reason that the Seller was not in default, or (ii) the Seller's failure to perform is without his and his subcontractor's control, fault, or negligence, the termination shall be deemed to be a termination for convenience under paragraph 12.
