The procurement seeks qualified vendors to provide comprehensive drug screening services for miner certifications and DMS employee testing, encompassing pre-certification testing for new miners and specialty certifications, post-accident testing following serious injuries or fatalities, disciplinary testing as ordered by the Kentucky Mine Safety Review Commission, and annual random employee screening. All testing must include a 15-panel urine test covering amphetamines, cannabinoids, cocaine, opiates, phencyclidine, benzodiazepines, propoxyphene, buprenorphine, methadone, barbiturates, mitragynine (kratom), fentanyl, synthetic opiates, synthetic cannabinoids, and MDMA. Vendors must establish collection sites within 30 minutes of four DMS district offices located in Harlan, Hazard, Madisonville, and Pikeville, operating Monday through Friday from 7:00 a.m. to 7:00 p.m., with after-hours emergency coverage capability. Results must be reported within eight calendar days and comply with Substance Abuse and Mental Health Services Administration (SAMHSA) regulations, with a licensed physician Medical Review Officer providing oversight. Estimated annual volumes include 3,000 pre-certification drug screens, 10 post-accident tests, 3,000 MRO reviews, and 100 random selection administration activities, plus additional services such as donor-requested retests, confirmation testing, litigation support, and expert witness testimony. Written questions were due April 23, 2026, and proposals are due by 3:30 p.m. Eastern Time on May 7, 2026, for the contract term running July 1, 2026, through June 30, 2028, with options for up to two additional two-year renewal periods. Technical proposals will be evaluated on 2,300 points based on previous experience (500 points), qualifications and certifications (500 points), online recordkeeping systems and chain of custody procedures (500 points), collection site availability and post-accident testing procedures (500 points), and laboratory operations and sample handling (300 points), while cost proposals are worth 700 points and oral presentations may add up to 200 additional points.

This re-solicitation follows an unsuccessful prior RFP (RFP 128 2600000103 closed January 7, 2026), and no incumbent vendor information is specified in the procurement documents. Vendors must maintain current SAMHSA certification and qualified forensic toxicology support, along with Commercial General Liability Insurance of at least $1,000,000 per occurrence and $2,000,000 aggregate, Professional Liability Insurance of $1,000,000 per claim, and Automobile Liability Insurance if applicable. All vendors must comply with Kentucky civil rights laws, executive branch ethics codes, ADA and HIPAA regulations, and new AI disclosure requirements under CIO-126 policy. The solicitation does not identify specific set-asides or restrictions on the types of organizations that can respond, nor does it specify disadvantaged enterprise designations or preferences. The cost proposal, submitted under separate cover on Attachment A, must include an all-inclusive rate per test covering specimen collection, overnight transportation, laboratory analysis, and Medical Review Officer review, with the lowest-priced proposal receiving maximum points and remaining proposals scored proportionally; however, the specific award value or budget range is not disclosed in the RFP documents.
