About this opportunity
The City of Eugene, Oregon is soliciting bids for HVAC and electrical improvements at the Technical Resilience Center under ITB 2026-2048, with bids due August 18, 2026. Portions of the bid documents are classified Confidential due to public safety concerns, and all pre-bid attendees and anyone accessing confidential materials must execute a Nondisclosure Agreement before obtaining responsive bid documents — this is a gating requirement for participation.
The scope covers mechanical and electrical system upgrades and installation of owner-furnished uninterrupted power supply units at 500 E 4th Ave, Eugene, Oregon. Bidders must attend a pre-bid conference and sign the NDA as a condition of accessing the full project manual and confidential specifications. The NDA restricts use of confidential information to bid preparation; limits dissemination to employees and officers with legitimate need-to-know; requires the same security protocols bidders apply to their own sensitive information; and mandates notification to the City within 24 hours of any suspected or actual unauthorized disclosure. Bidders may not disclose confidential materials to third parties without prior written City consent and a separate signed NDA from the third party. Upon NDA expiration — triggered by either contract execution with the successful bidder or one month after the effective date, whichever is earlier — bidders must return all physical documents and delete all electronic files. Bidders indemnify the City against claims arising from misuse of confidential information and consent to injunctive relief for breach. The NDA is governed by Oregon law with exclusive jurisdiction in Lane County Circuit Court or the United States District Court for the District of Oregon, Eugene Division. The City retains the right to terminate the NDA on one day's written notice if deemed in the public interest.
