About this opportunity

The Commonwealth of Kentucky, through the Kentucky Transportation Cabinet (KYTC) Division of Purchases on behalf of the Division of Materials, issued a competitive sealed bid solicitation for 7,200 units of clear polyethylene bags measuring 17.5 inches by 26 inches with a minimum thickness of 7 mils (0.007 inches). The bags must feature molded seams with special wide bottom seals, be capable of holding 80 or more pounds of material, and withstand rough handling without compromising integrity. These bags will be used by the Division of Materials and all twelve highway district materials laboratories throughout Kentucky for transporting and storing rock, sand, soil, asphalt mix, and other miscellaneous materials. The solicitation establishes a master agreement contract with an initial period running through June 30, 2021, with four optional one-year renewal periods available subject to mutual written approval of both the vendor and KYTC Division of Purchases. Bidders were required to submit signed bid documents, detailed product specifications, and a minimum of three physical samples for inspection by the Division of Materials prior to contract award. The solicitation was evaluated on a best-value basis using a ranking approach, with price weighted at 95 of 100 available points and delivery time weighted at 5 points, with the deadline for written questions set for June 10, 2020, at 3:30 p.m. and Commonwealth responses issued June 11, 2020, by 7:00 p.m. Bid submissions were due by June 23, 2020, at 10:00 a.m., with a tentative award date of July 1, 2020, and bids accepted via mail (US Postal Service, UPS, or FedEx) or email to KYTC.Bids@ky.gov.

Pricing must be quoted on an F.O.B. Destination Freight Prepaid basis, with the vendor bearing all shipping and freight costs and filing responsibility for freight claims, and no price increases permitted during the first twelve months of the contract; only one increase is allowed during the contract period based on industry-wide price changes with thirty days' written notice and supporting documentation. The solicitation is subject to Kentucky resident bidder reciprocal preferences per Kentucky Revised Statutes 45A.490-494 and qualified bidder preferences per 200 KAR 5:410, which include preferences for Kentucky Correctional Industries and nonprofit organizations serving individuals with disabilities. Vendors claiming Kentucky resident bidder status must submit the Required Affidavit for Bidders, Offerors, and Contractors Claiming Resident Bidder Status, while nonresident bidders must provide their Secretary of State Certificate of Authority. The contract specifies a one percent per day deduction from invoices for each day the vendor fails to meet the contracted delivery date, except for delays caused by circumstances beyond the vendor's control or Commonwealth actions. The solicitation documents do not identify incumbent vendors, current contractors, or specific budget values; however, the procurement references baseline pricing from previous procurements to ensure competitive bidding and funding derived from the procuring agency's operational budget with specific allocation amounts designated for poly bag inventory needs.
