Notice text

1. Agency and Contracting Activity:
U.S. Immigration and Customs Enforcement (ICE), Office of Acquisition Management (OAQ)
2. Nature/Description of Action:
The Office of Acquisition Management (OAQ) procured on behalf of ICE Air Operations (IAO) 60 Wrap restraint systems.
3. Description of Supplies/Services Required and Estimated Value:
The requirement was to provide IAO with a safe method to temporarily restrain a detainee, during removal, who may be non-compliant, overly aggressive, combative or in a highly agitated state. The application of soft restraints is required to ensure the person does not cause serious injury or bodily harm to themselves or others in the performance of their duties. IAO requires these soft restraint devices in order to conduct removal operations in a safe, effective manner. Accord to the Office of Training and Tactical Programs, "The WRAP" restraint system is the only product that is authorized for use when soft restraints devices are required. The WRAP restraint system is available on GSA schedule, Contract #GS-07F-089DA.
4. Authority and Supporting Rational:

a. Acquisition Authority:
This acquisition was conducted under the authority of FAR 8.405-6(a)(1)(i)(B) which allows the contracting officer and contract specialist to restrict consideration to a single schedule contractor when "only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized."

b. Supporting Rational:

The Office of Training and Tactical Programs (OTTP) has published updated Authorized Restraints Device Guidelines, dated September 18, 2017. This update removed the Humane Restraint Blanket (HRB) as an authorized soft restraint device and added "The Wrap" soft restraint device as the only authorized soft restraint device. "The WRAP" device is only available for purchase from the Safe Restraints, Inc.

5. Contracting Officer Best Value Determination (FAR 8.404(d)):

The government determined that the delivery order represents the best value consistent with FAR 8.404(d). The following was considered when deciding if the proposed delivery order award represents the greatest overall benefit to the government, considering price and administrative costs:
1) GSA has already determined that the prices listed under GSA Contract #GS-07F-089DA (the applicable schedule contract) are fair and reasonable; and

2) Upon request, Safe Restraints Inc. provided a discounted price that is lower than the GSA contract price.

6. Market Research:

Market research consisted of searching the General Services Administration website (GSA Advantage!) for any additional suppliers/distributers of "The Wrap" by Safe Restraints Inc.

7. Additional Facts Supporting Justification: N/A

8. Actions Taken to Overcome Barriers that Led to Restricted Consideration:

There is no way to avoid restricting consideration due to the fact that these restraint devices need to be pre-approved by the Office of Training and Tactical Programs
