About this opportunity
The National Institute of Standards and Technology (NIST), operating under the Department of Commerce, published this Special Notice on April 21, 2026, regarding water and sewer utility services for its Gaithersburg, Maryland campus. NIST intends to contract on a sole source basis with the Washington Suburban Sanitary Commission (WSSC) to provide these essential utility services. The procurement is being pursued as a noncompetitive acquisition under Federal Acquisition Regulation (FAR) 6.302-1, which permits sole source contracting when only one responsible source can satisfy agency requirements. WSSC is the exclusive provider of water and wastewater services in Montgomery County, Maryland, where Gaithersburg is located, making it the only viable source for this service. No competitive solicitation package will be issued for this requirement.
The underlying objective of this Special Notice is to notify the public of NIST's intention to enter into a sole source contract with WSSC for continuous water and sewer utility services supporting daily campus operations. The contract period runs from May 1, 2026 through April 30, 2027, with an estimated value of $4,110,409, based on historical usage data and WSSC's published annual rates. The due date for inquiries regarding this procurement is May 20, 2026, and interested parties must submit all communications via email to helen.wesley@nist.gov and tony.schmidt@nist.gov only; telephone inquiries will not be accepted. There are no eligibility criteria for participation since this is a sole source procurement rather than a competitive opportunity. The Government retains sole discretion to determine whether to conduct a competitive procurement in the future based on any responses received to this notice.
