About this opportunity
The Department of Commerce's National Institute of Standards and Technology (NIST) has issued a Special Notice for water and sewer utility services for its Gaithersburg, Maryland campus. The notice indicates NIST's intent to contract solely with Washington Suburban Sanitary Commission (WSSC) for utility services, as WSSC is the exclusive provider of water and wastewater services in Montgomery County. This procurement will be conducted on a sole source basis under Federal Acquisition Regulation (FAR) 6.302-1, which allows for procurement from only one responsible source when no other supplies or services can satisfy agency requirements. The contract falls under NAICS Code 924110 for Administration of Air and Water Resources and Solid Waste Management Program. The special notice was posted on March 27, 2025, with a response deadline of April 26, 2025.
The purpose of this Special Notice is to establish a utility services contract for NIST's daily campus operations, with WSSC being the only eligible contractor due to its exclusive service territory. The contract period will run from April 1, 2025, through April 30, 2026, with a total estimated value of $3,777,510.80, covering water and sewer services. No competitive solicitation will be issued, and no telephone inquiries will be accepted, with all communications directed to specific email contacts: helen.wesley@nist.gov and tony.schmidt@nist.gov. WSSC, a non-profit public entity serving approximately 1.8 million people across a 1,000-square-mile area, will provide services at annually published fixed rates that the Contracting Officer has determined to be fair and reasonable. Market research has confirmed no alternative service providers exist in the specified geographic area, further justifying the sole-source procurement approach.
