About this opportunity

The United States Army Corps of Engineers Baltimore District intends to award a sole-source contract modification extending the period of performance on Task Order W912DR21F0329 under Contract W912DR18D0003 with Leidos, Inc., with responses due by August 3, 2026. The modification extends architect-engineer environmental services at Former Nansemond Ordnance Depot, Suffolk, Virginia for 2 years and 8 months to complete highly specialized, non-severable deliverables that Leidos has been performing since the task order was awarded in 2021. The scope includes completion of the field scale treatability study, proposed plan, and record of decision for the TNT Area (Source Area 1) under CERCLA, as well as feasibility studies, proposed plans, and records of decision at Project 17 and 19 and Nansemond River Beachfront (Source Area 15). The sole-source justification rests on Leidos being the only responsible source capable of completing the non-severable requirement, as awarding to another source would result in substantial duplication of costs to the Government unrecoverable through competition. The modification is authorized under 10 U.S.C. 3204(a)(1) as implemented by RFO 6.103-1 (DFARS CD 2026-O0017).

Notice text

This notice is being published in accordance with the Revolutionary Federal Acquisition Regulation Overhaul (RFO) requiring the dissemination of information on proposed contract actions. This is a notice of intent to award a contract modification utilizing other than full and open competition. The statutory authority for this contract modification is 10 U.S.C. 3204(a)(1), as implemented by RFO 6.103-1(DFARS CD 2026-O0017) “Only one responsible source and no other supplies or services will satisfy agency requirements.”

The United States Army Corps of Engineers (USACE) Baltimore District (NAB) intends to solicit and award an out of scope contract modification to Contract No. W912DR18D0003 Task Order No. W912DR21F0329 with Leidos, Inc. for architect-engineer environmental services being performed at Former Nansemond Ordnance Depot, Suffolk, Virgina. This modification will consist of a period of performance extension in the amount of 2 years and 8 months allowing the architect-engineer firm to complete the highly specialized, non-severable services originally awarded under the Task Order. This includes completion of the field scale treatability study, the proposed plan, and record of decision in accordance with the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) at the TNT Area designated as Source Area 1 as well as completion of other deliverables such as feasibility studies, proposed plans, and record of decisions at Project 17 and 19 and Nansemond River Beachfront designated as Source Area 15.

Because Leidos, Inc. has been in the process of completing the highly specialized, architect-engineer services on the existing task order since the task order was awarded in 2021, Leidos, Inc. is considered the only responsible source to complete the non-severable requirement. Awarding completion of the requirement to another source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition and create unacceptable delays in fulfilling the agency’s requirement.

This notice is not a request for competitive proposals. All responsible sources may submit a capability statement which shall be considered by the agency. Capability statements must be received by the response date and time of this notice. Submissions will be reviewed to determine if they meet the requirement. A determination to compete this proposed acquisition based upon responses to this notice is solely at the discretion of the Government.
