About this opportunity
The U.S. International Boundary and Water Commission (USIBWC) has issued a Special Notice implementing a class deviation from the Federal Acquisition Regulation (FAR) in response to Executive Orders 14173 and 14168. The notice outlines significant changes to procurement processes affecting federal contract provisions and clauses. Specifically, the USIBWC is modifying its approach to solicitations and existing contracts by excluding certain standard representations and certifications. The deviation impacts multiple FAR provisions related to annual representations, commercial products and services, and sustainability requirements. The special notice is part of a broader federal effort to update procurement guidelines and streamline contract documentation.
Contractors should note the key requirements include the exclusion of specific provisions such as biobased product certifications and sustainability-related clauses from new solicitations and contracts. The USIBWC will implement changes to existing contracts through unilateral modifications when feasible, with all changes to be published on their webpage. While the System for Award Management (SAM) may continue to display some outdated representations, agencies will not consider or use these representations in contract evaluations. The notice specifically addresses changes related to Executive Orders 14208 and 14057, including the removal of non-statutory sustainability requirements for items like food service wares. Contractors are advised that system updates may lag behind these policy changes, and they are not required to update their entity registrations in response to these modifications.
