About this opportunity
The United States Patent and Trademark Office (USPTO) has a requirement for Storage Infrastructure Managed Services (SIMS). The USPTO is procuring this requirement under its special procurement authorities granted by the Patent and Trademark Office Efficiency Act, 35 U.S.C. 2(b)(4)(A), and has determined that Peraton, Inc. is the only vendor qualified and eligible for award. The contract will be a single award to Peraton, Inc. for a base period of one year with two one-year option periods, with a total estimated value of $70.8M. The place of performance will be the USPTO's headquarters and primary data center locations. Peraton's response is due by November 8, 2024, and the anticipated award date is November 27, 2024. This is a sole source procurement, and no competitive proposals are being requested.
There is no set-aside designation for this requirement. Peraton, Inc. is the incumbent contractor and the only vendor determined to be capable of meeting the USPTO's needs. The total anticipated value of the contract, including the base period and two option years, is $70.8M. The USPTO is pursuing this sole source contract due to the accelerated cloud migration plan, whereby 100% of cloud-appropriate systems will move to the cloud by the end of fiscal year 2027, which would make the infrastructure buyout cost an insurmountable financial burden.
Notice text
The United States Patent and Trademark Office (USPTO) has a requirement for Storage Infrastructure Managed Services (SIMS).
As a result of the USPTO’s exemption from the Competition in Contracting Act, the SIMS requirement is being procured by leveraging the Patent and Trademark Office Efficiency Act, 35 U.S.C. § 2(b)(4)(A).
Based on the circumstances described in the attached sole source justification, the USPTO determined that no company other than Peraton, Inc. can successfully meet the agency’s needs.
