About this opportunity

The Food and Drug Administration is seeking state and territorial government agencies to conduct tobacco retail compliance inspections under the Tobacco Control Act across eight specific US states (California, Illinois, Michigan, Minnesota, New Jersey, Pennsylvania, Washington, and Wisconsin) and the territories of American Samoa and Northern Mariana Islands. This Request for Proposal solicits services for inspecting retail establishments that sell cigarettes and smokeless tobacco products, including undercover buy operations and advertising/labeling surveillance to ensure compliance with federal age, packaging, and marketing restrictions. Only state, territorial, or local government agencies with the authority to create, enforce, or administer rules governing private entities are eligible to propose. Proposals will be evaluated based on technical capability to meet FDA requirements, past performance, and cost reasonableness. The solicitation deadline has been extended to August 27, 2025, at 10:00 AM ET, with questions due by August 12, 2025, and a pre-proposal conference held on August 14, 2025.

This procurement does not utilize any set-aside designations and current contract incumbents are not required to submit full technical proposals, suggesting existing contractors may have an advantage. The contract structure is a five-year Indefinite Delivery/Indefinite Quantity cost-reimbursement arrangement with estimated values ranging from $38,247 to $17,270,436 per jurisdiction depending on inspection volumes. The maximum scope includes 17,500 Underage Buyer inspections and 2,500 Adult & Licensee inspections over the contract period, with annual task orders and limitations of $20,000 per year for other direct costs and $10,000 per year for non-inspection travel. Performance will occur across the specified states and territories, with contract management centered in Rockville, Maryland, and requires contractors to commission local inspectors, recruit and train underage purchasers aged 16-20, and document results using FDA's Tobacco Inspection Management System.
