About this opportunity
The Food and Drug Administration's Center for Tobacco Products is seeking information from state agencies regarding their capability to conduct the State Retail Tobacco Compliance Inspections Program from fiscal years 2024 through 2029. Responding agencies must be a state or territorial government entity with the authority to perform undercover buy inspections and labeling/advertising inspections of tobacco retailers to evaluate compliance with federal laws and regulations. The FDA will award one indefinite delivery/indefinite quantity contract per state or territory lasting five years, with annual cost-reimbursement task orders. Responses to seven capability questions assessing staffing, contract administration, and inspection performance are due by December 13, 2023.
There is no set-aside designation for this opportunity. The NAICS code is 541611 and PSC code is R425. Current contractors were not named but the solicitation specifies that only state government agencies are qualified to respond. The total value of each individual contract is not specified but the period of performance through 2029 suggests multi-year budgets in the millions of dollars may be involved given the scope of inspections required across all 50 states and territories.
