About this opportunity
The Export-Import Bank of the United States (EXIM Bank) has issued a Special Notice announcing its intent to award a sole-source follow-on contract for asset protection and recovery services under Product/Service Code R418 (Support - Professional: Legal). This opportunity pertains to collecting outstanding amounts owed to EXIM by obligors and guarantors in Argentina and Brazil, specifically for case G086774 involving defaulted loans. The applicable NAICS code is 541110 (Offices of Lawyers), which carries a $16 million size standard. The contract will be performed at EXIM Bank's headquarters in Washington, D.C., and in Argentina. The Special Notice was posted on February 18, 2026, with a submission deadline of March 5, 2026. Contracting Officer Travis Finkle serves as the primary point of contact for this acquisition.
This follow-on contract award to the incumbent vendor, Bertone, Santiago, is justified under FAR 6.302-1 (Only One Responsible Source) and FAR 16.505(2)(c), as the vendor possesses unique qualifications essential for executing recovery efforts in the Brazil/Argentina jurisdictions, including specialized expertise in asset location, foreign court litigation, and established knowledge of Brazilian and Argentine legal systems. The contract is structured with a five-year period of performance and includes three primary tasks: submission of a written recovery plan and collectable amount estimate within 60 days, filing fee documentation and approval through contract modification, and contingency-based payment for recovered defaulted principal. Eligible contractors must demonstrate full knowledge of the Argentine judicial system and maintain registration as a qualified attorney in Argentina if litigation is pursued. The contract establishes performance standards with a 99 percent acceptable quality level for litigation response and timeliness, with compensation tied directly to actual cash recoveries on a contingency basis as specified in the Case Assignment Letter.

Synopsis – 83310126Q0017 | Claim(s) in Argentina & Brazil (Follow-on)
EXIM Bank, headquartered in Washington, D.C., is providing this notice of intent to issue a sole source a follow-on award to provide asset protection and recovery services.
The applicable Product/Service Code is R418.
The applicable North American Industry Classification System (NAICS) code is 541110 - Offices of Lawyers, which has a size standard of $16M.
This requirement is to assist EXIM in its efforts to collect outstanding amounts owed to EXIM by the obligor/buyer and all guarantors, if any. These efforts will include, as EXIM may direct, asset searches, site visits, negotiations, litigation, documentation of agreements, embargoing assets and executing upon assets. See attached PWS.
When an individual AMD recovery contract ends but the recovery action is still pending resolution, we award follow-on contracts on a sole source basis to the original vendor (per FAR 16.505(2)(c)) as long as it is for the same recovery case(s). The rationale for this is the combination of contingency payment agreement and the frequent long length of the recovery process. With limited vendor availability, if we did not follow this practice, the original vendor could perform most of the work and the subsequent vendor would reap the rewards of any funds recovered. By awarding follow-on contracts in this manner, we establish fairness for the vendors in an unusual situation, retain good relations with a limited vendor pool for future needs, and therefore get the best long-term benefit to the government.
