About this opportunity

The Commodity Futures Trading Commission (CFTC) intends to negotiate and award a sole-source contract for the procurement of insurance index and integration constituent data feeds from S&P Global. The agency plans to award a one-year base contract with four one-year options for a total period of performance of five years. CFTC has determined that the information contained in the S&P Global subscriptions is proprietary and that the agency knows of no alternative source that can provide the required data, which is essential for its regulatory operations. The Pre-Solicitation Notice states that this is not a request for competitive proposals, but the government will consider responses from responsible sources to determine if a competitive procurement should be conducted instead of the sole-source award. Responses must be submitted in writing and include information to establish the responding organization's capability to fulfill the requirement.

This contract opportunity is not set-aside for any specific business category. The CFTC indicates that S&P Global is the only identified responsible source reasonably available to satisfy the agency's requirements. The value of the potential contract is not specified, but the total period of performance is five years. The agency requires the Compustat with Market Data and S&P U.S. Index-1000-ALL subscriptions from S&P Global.

Notice text

The Commodity Futures Trading Commission ("CFTC") intends to negotiate and award a sole-source contract for the procurement of insurance index and integration constituent data feeds from S&P Global.  The Government intends to procure this requirement under 41 U.S.C. §3304 (a)(1) and FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.  CFTC intends to award a contract with a one (1) year base period, and four (4) one-year options, for a total period of performance of five (5) years.

The information contained in the S&P Global subscriptions are proprietary to S&P and CFTC knows of no alternative source that can provide the information offered in the subscriptions below.  The list of the subscriptions that CFTC intends to procure from S&P is as follows:

  • Compustat with Market Data
  • S&P U.S. Index-1000-ALL

Without access to this data, CFTC’s regulatory operations would be significantly impeded and there would be an increased risk to achieving CFTC’s mission. This vendor is the only responsible source identified as reasonably available that will satisfy the agency requirements.

THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS and a solicitation will not be issued.  However, the Government will consider responses from all responsible sources received by the date and time identified above.  Written responses must include sufficient information to establish capability to fulfill the requirement.  Oral communications are not acceptable in response to this notice.  Any responses received will only be considered for the purposes of determining whether to conduct a competitive procurement in lieu of the sole source described in this notice, and such determination shall be made at the sole discretion of the CFTC.
